CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-316 <br /> <br /> RESOLUTION DENYING THE APPEAL OF A <br /> DECISION OF THE BOARD OF ADJUSTMENT AND <br /> GRANTING THE APPLICATION OF WILLIAM C. <br /> LAWSON FOR A VARIANCE AS FILED UNDER CASE <br /> V-89-6 <br /> <br />WHEREAS, at its meeting of May 24, 1989, the Board of <br /> Adjustment approved the application of William C. <br /> Lawson for a variance to allow retention of a <br /> carport which encroaches into the required side <br /> yard setback at 3866 Mammoth Cave Court; and <br /> <br />WHEREAS, zoning for the property is R-1-6500 (Single-family <br /> Residential) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the City Council submitted an <br /> appeal to the City Clerk of the City of Pleasanton; <br /> and <br /> <br />WHEREAS, a duly noticed public hearing was held before the <br /> City Council on July 18, 1989 at which time the <br /> applicant and other members of the public were <br /> offered an opportunity to present evidence <br /> regarding this appeal; and <br /> <br />WHEREAS, the City Council made the following findings: <br /> <br /> 1. That special circumstances unique to the site <br /> are to be found. <br /> <br /> 2. That the proposal will not constitute a grant <br /> of special privilege. <br /> <br /> 3. That the health, safety and general welfare of <br /> the surrounding area re not jeopardized by the <br /> request. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of the City Council, and <br /> upholds approval of the application of William C. <br /> Lawson for a variance from the ordinance code <br /> allowing the retention of a carport which <br /> encroaches into the required side yard setback at <br /> 3866 Mammoth Cave Court. <br /> <br /> <br />
