PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION N0. 2771 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR NOLAN FRANCE AS FILED UNDER CASE UP-86-4 WHEREAS, Nolan France has applied for a conditional use permit for an automobile brake, tire mounting/alignment, and repair facility located at 7034-H Commerce Circle; and WHEREAS, zoning for the property is IG-40,000 (General Industrial) District; and WHEREAS, at their duly noticed public hearing of March 10, 1986 the Planning Commission considered all public testimony, relevant exhibits and recommendations of the City staff concerning this application; and WHEREAS, the Planning Commission found a) that the proposed location of the conditional use is in accordance with the objectives of the zoning ordinance and the purposes of the district in which the site is located: the proposed use is considered to be similar in nature to the conditionally permitted use of "service station". b) that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity: with the securing of appropriate City permits, parking, and expansion, this use is compatible with other uses allowed in the area and within the structure and site in which it is located c) that the proposed conditional use will comply with each of the applicable provisions of this chapter: and as proposed and conditioned, each applicable provision will be satisfied. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-86-4, application of Nolan France for a conditional use permit for an automobile brake, tire mounting/alignment, and repair facility located at 7034-H Commerce Circle subject to the following conditions: - 1 -
