6.52.020 <br />6.52.020 Short Title: <br />This chapter shall constitute the <br />CABLE SYSTEM REGULATORY ORDI- <br />NANCE of the city of Pleasanton and <br />may be referred to as such. (Ord.. 1829 <br />§ 2, 2001) <br />6.52.030 Definitions: <br />For the purposes of this chapter, the <br />following terms, phrases, words and <br />their derivations shall have the mean- <br />ings given herein. Words used in the <br />present tense include the future, words <br />in the plural number include the singu- <br />lar number, and words in the singular <br />number include the plural number. <br />Words not defined shall be given their <br />common and ordinary meaning. <br />A. "Basic cable service" means any <br />service tier which includes the retrans- <br />mission of local television broadcast <br />signals. <br />B. "Cable operator" means any per- <br />son or group of persons who: <br />1. Provides cable service over a <br />cable system and directly or through <br />one or more affiliates owns a signif- <br />icant interest in such cable system; or <br />2. Otherwise controls or is responsi- <br />ble for, through any arrangement, the <br />management and operation of such <br />cable system. <br />C. "Cable service" means: <br />1. The one-way transmission to sub- <br />scribers of: <br />a. Video programming; or <br />b. Other programming service; and <br />2. Subscriber interaction, if any, <br />which is required for the selection or <br />use of such video programming or other <br />programming service. <br />D. "Cable system" or "System" <br />means a facility, consisting of a set of <br />closed transmission paths and associat- <br />ed signal generation, reception, and <br />control equipment that is designed to <br />provide cable service which includes <br />video programming and which is pro- <br />vided to multiple subscribers within a <br />community, but such term does not <br />include: <br />1. A facility that serves only to re- <br />transmit television signals of one or <br />more television broadcast stations; <br />2. A facility that serves subscribers <br />without using any public rights of way; <br />3. A facility of a common carrier <br />which is subject, in whole or in part, to <br />the provisions of title II of the com- <br />munications act of 1934, as amended, <br />except that such facility shall be con- <br />sidered acable system (other than for <br />the purposes of 47 USC 541) to the <br />extent such facility is used in the trans- <br />mission of video programming directly <br />to subscribers; unless the extent of such <br />use is solely to provide interactive on <br />demand services; <br />4. An open video system that com- <br />plies with 47 USC 573; or <br />5. Any facilities of any electric utili- <br />ty used solely for operating its electric <br />utility system. <br />E. "Channel" or "Cable channel" <br />means a portion of the electromagnetic <br />frequency spectrum which is used in a <br />cable system and which is capable of <br />delivering a television channel as de- <br />fined by the federal communications <br />commission. <br />F.
