6.52.020 6.52.020 Short Title: This chapter shall constitute the CABLE SYSTEM REGULATORY ORDI- NANCE of the city of Pleasanton and may be referred to as such. (Ord.. 1829 § 2, 2001) 6.52.030 Definitions: For the purposes of this chapter, the following terms, phrases, words and their derivations shall have the mean- ings given herein. Words used in the present tense include the future, words in the plural number include the singu- lar number, and words in the singular number include the plural number. Words not defined shall be given their common and ordinary meaning. A. "Basic cable service" means any service tier which includes the retrans- mission of local television broadcast signals. B. "Cable operator" means any per- son or group of persons who: 1. Provides cable service over a cable system and directly or through one or more affiliates owns a signif- icant interest in such cable system; or 2. Otherwise controls or is responsi- ble for, through any arrangement, the management and operation of such cable system. C. "Cable service" means: 1. The one-way transmission to sub- scribers of: a. Video programming; or b. Other programming service; and 2. Subscriber interaction, if any, which is required for the selection or use of such video programming or other programming service. D. "Cable system" or "System" means a facility, consisting of a set of closed transmission paths and associat- ed signal generation, reception, and control equipment that is designed to provide cable service which includes video programming and which is pro- vided to multiple subscribers within a community, but such term does not include: 1. A facility that serves only to re- transmit television signals of one or more television broadcast stations; 2. A facility that serves subscribers without using any public rights of way; 3. A facility of a common carrier which is subject, in whole or in part, to the provisions of title II of the com- munications act of 1934, as amended, except that such facility shall be con- sidered acable system (other than for the purposes of 47 USC 541) to the extent such facility is used in the trans- mission of video programming directly to subscribers; unless the extent of such use is solely to provide interactive on demand services; 4. An open video system that com- plies with 47 USC 573; or 5. Any facilities of any electric utili- ty used solely for operating its electric utility system. E. "Channel" or "Cable channel" means a portion of the electromagnetic frequency spectrum which is used in a cable system and which is capable of delivering a television channel as de- fined by the federal communications commission.
