6.48.040 <br />6.48.040 Permit -Suspension Or <br />Revocation Procedure: <br />A. The health officer may order an <br />immediate suspension granted under <br />this chapter for a period of ten (10) <br />days; said order shall set forth his find- <br />ings. The health officer shall not revoke <br />a permit granted under this chapter <br />unless written notice of a hearing on <br />said revocation is served upon the <br />owner, occupant or other person in <br />charge of the permittee's business, at <br />least five (5) days before the hearing by <br />the health officer on the revocation of <br />the permit. Where, after diligent search, <br />such owner, or occupant or person in <br />control, cannot be found, a copy of <br />such notice shall be mailed to the per- <br />mittee at the place of business or resi- <br />dence at least five (5) days before the <br />hearing on the revocation of the permit. <br />No person shall operate the business or <br />maintain the fowl, game birds or horses <br />in the city during any time in which the <br />permit for the business or maintenance <br />has been suspended or revoked. <br />B. In the event that any permittee <br />whose license has been revoked pursu- <br />ant to the provisions of this chapter, is <br />dissatisfied with such decision of the <br />health officer, he shall have the right, <br />within ten (10) days after the date of <br />the revocation of such permit, >no appeal <br />the order revoking the permit to the <br />city council, which appeal must be in <br />writing, and upon receipt thereof the <br />city council will set a time and place <br />for the hearing of the appeal before the <br />city council, and the decision of a ma- <br />jority of the members of the city coun- <br />cil on the appeal shall be final.
