11.44.130 <br />vehicle on said land but does not ap- <br />peaz, or if an interested party makes a <br />written presentation to the City Man- <br />ager but does not appear, the owner of <br />the land shall be notified in writing of <br />the decision. (Ord. 1797 § 1, 1999; <br />Prior Code Art. 1 § 5-7.12) <br />11.44.140 Appeal: <br />A. Any interested pazty may appeal <br />the decision of the City Manager by <br />filing a written notice of appeal with <br />the City Manager within five (5) days <br />after the City Manager's decision. <br />B. Such appeal shall be heazd by the <br />City Council which may affirm, amend <br />or reverse the order to take other action <br />deemed appropriate. <br />C. The Clerk shall give written no- <br />tice of the time and place of the hearing <br />to the appellant and those persons spec- <br />ified in Section 11.44.100 of this Chap- <br />ter. <br />D. In conducting the hearing the City <br />Council shall not be limited to the <br />technical rules of evidence. (Ord. 1797 <br />§ 1, 1999; Prior Code Art. 1 § 5-7.13) <br />11.44.150 Disposal: <br />Five (5) days after adoption of the <br />order declaring the vehicle or parts <br />thereof to be a public nuisance, five (5) <br />days from the date of mailing or other <br />service of notice of the decision if such <br />notice is required by Section 11.44.130 <br />of this Chapter, or fifteen (15) days <br />after such action of the governing body <br />authorizing removal following appeal, <br />the vehicle or parts thereof may be <br />disposed of by removal to a scrapyazd <br />or automobile dismantler's yard. After <br />a vehicle has been removed it shall not <br />thereafter be reconstructed or made <br />operable unless it is a vehicle which <br />qualifies for either horseless carnage <br />license plates or historical vehicle li- <br />cense plates, pursuant to section 5004 <br />of the California Vehicle Code, in <br />which case the vehicle may be recon- <br />structed or made operable. (Ord. 1797 <br />§ 1, 1999; Ord. 1222 § 20, 1985; Prior <br />Code Art. 1 § 5-7.14) <br />11.44.160 Notice Of Removal To <br />Department Of Motor <br />Vehicles: <br />Within five (5) days after the date of <br />removal of the vehicle or pazts thereof, <br />notice shall be given to the Department <br />of Motor Vehicles identifying the vehi- <br />cle or parts thereof removed. At the <br />same time there shall be transmitted to <br />the Department of Motor Vehicles any <br />evidence of registration available, in- <br />cluding registration certificates, certifi- <br />cates of title and license plates.
