3.40.090 <br />do not replace existing development fees, <br />except as the Council may specifically <br />provide, do not replace connection charg- <br />es levied on a Citywide basis, or limit <br />requirements or conditions to provide <br />additional site-specific mitigation of site- <br />specific impacts imposed upon develop- <br />ment projects pursuant to Titles 18, 19, <br />and 20 of this Code. (Ord. 1772 § 3, <br />1999) <br />3.40.100 Refund Of Fee: <br />A. During the annual review of the <br />area development impact fee pursuant to <br />Section 3.40.110 of this Chapter, the City <br />Council shall make a finding with respect <br />to any fee revenue not expended or com- <br />mitted five (5) years or more after it was <br />paid. If the City Council fmds that the fee <br />revenue is not committed, it shall autho- <br />rize arefund to the then owner of the <br />property for which the fee was paid, <br />pursuant to Government Code section <br />66001. (Ord. 1772 § 3, 1999) <br />3.40.110 Annual Review: <br />The area development impact fee au- <br />thorized by this Chapter and implemented <br />by Council resolution(s), the accumulated <br />fee funds and their appropriation, and <br />supporting documentation, including the <br />technical report, shall be reviewed annu- <br />ally by the City Council. (Ord. 1772 § 3, <br />1999) <br />3.40.120 Termination Of Fee: <br />The City shall cease collecting the area <br />development impact fee established by <br />this Chapter fifteen (15) years following <br />the effective date hereof.
