3.40.040 <br />3. Lund Ranch; <br />4. Spotorno property; <br />5. Golf course: <br />a. Golf course residential; <br />b. Golf course clubhouse and ancillary <br />facilities. <br />B. Amount Of The Fee: The amounts <br />and calculation of each azea development <br />impact fee shall be established by resolu- <br />tion of the City Council and shall be <br />based upon the following considerations: <br />1. New development will pay only for <br />the construction of those public facilities <br />where there is a reasonable relationship <br />between the facilities funded and the <br />demands and needs generated by the new <br />development. <br />2. Each type of new development shall <br />contribute to the funding of the needed <br />facilities in proportion to the need for the <br />facilities created by that type of develop- <br />ment. <br />3. The public facilities funded by the <br />azea development impact fee and the <br />calculations resulting in the azea devel- <br />opment impact fee amount aze document- <br />ed in the technical report. <br />C. Applications Requiring Payment Of <br />Fee: <br />1. Subdivision: A person who applies <br />for a residential subdivision for properties <br />identified in subsection 3.40.030C of this <br />Chapter shall pay to the City, prior to the <br />approval of the final map, an azea devel- <br />opment impact fee in the amount set forth <br />in the City's adopted Master Fee Sched- <br />uler. <br />2. Building Permit: A person who ap- <br />plies for a building permit for new com- <br />mercial construction, for a new residential <br />unit, or for a substantial remodel, within <br />1. The Master Fee Schedule is on file in the office of the City Clerk. <br />the properties identified in subsection <br />3.40.030C of this Chapter shall pay to the <br />City, upon issuance of the permit, an azea <br />development impact fee in the amount set <br />forth in the Master Fee Scheduler, unless <br />the azea development impact fee for that <br />property has already been paid. <br />D. Fee Unit: The unit basis of the fee <br />shall be: <br />1. Residential Fees: The azea develop- <br />ment impact fee for residential construc- <br />tion shall be chazged for each new lot <br />shaze with a specific azea development <br />impact fee amount set for each unit type <br />referenced in this Chapter. <br />2. Fees For Nonresidential Uses: The <br />azea development impact fee for nonresi- <br />dential construction shall be chazged on a <br />per residential lot share equivalent basis. <br />3. Fees For Other Uses: Uses not spec- <br />ified in the technical report or the area <br />development impact fee resolution shall <br />be calculated by the Planning Director on <br />the basis of the facility costs and alloca- <br />tion methods used for the specified uses <br />on a per residential lot shaze equivalent <br />basis. <br />E. Formula For Calculating The Fees: <br />The azea development impact fee shall be <br />determined by a formula that is based on <br />the cost of the required infrastructure <br />facilities, the proportion of those costs <br />attributable to development in the North <br />Sycamore Specific Plan Area and certain <br />other azeas as a whole, and each unit of <br />development's proportional shaze of the <br />North Sycamore Specific Plan Area costs <br />as a whole.
