6.24.180 <br />aged, conducted, or maintained without <br />regard for public safety or public <br />health. <br />7. For purposes of this Section, per- <br />mittee, in the case of a massage estab- <br />lishment, shall include the managing <br />responsible officer or managing em- <br />ployee. <br />B. Prior to the suspension or revoca- <br />tion of any permit issued pursuant to <br />this Chapter, a hearing, as provided in <br />Section 6.24.100 of this Chapter, shall <br />be held by the Police Chief. Written <br />notice of the grounds for the hearing, as <br />well as its time and place, shall be sent <br />by certified mail to the address shown <br />on the application or by hand delivery <br />to the permittee at least seven (7) days <br />prior to said hearing. Written notice of <br />the Police Chief's decision shall be <br />mailed to the permittee within seven (7) <br />working days following the hearing. No <br />privilege to provide massage services <br />shall exist from the time written notice <br />is served, pending decision by the Po- <br />lice Chief. (Ord. 1727 § 2, 1997) <br />6.24.190 Appeal Of Revocation Or <br />Suspension: <br />No later than fifteen (15) calendar <br />days after service of notice of revo- <br />cation, suspension, denial of applica- <br />tion, or renewal, the permittee may <br />appeal to the City Manager by the <br />procedure for appeal as set forth in <br />Section 6.24.100 of this Chapter. The <br />hearing and notice of the decision shall <br />be given in the same manner as provid- <br />ed in Section 6.24.100 of this Chapter. <br />The decision of the City Manager shall <br />be final. (Ord. 1727 § 2, 1997) <br />6.24.200 Burden Of Proof: <br />Unless otherwise specifically prohib- <br />ited by law, the burden of proof is on <br />the applicant or permittee in any hear- <br />ing or other matter under this Chapter. <br />(Ord. 1727 § 2, 1997) <br />6.24.210 Permit Duration And <br />Renewal: <br />A. A permit shall be valid for two <br />(2) years from the date of issuance <br />unless revoked or suspended. <br />B. A permittee may apply fora re- <br />newal of a permit thirty (30) days prior <br />to the expiration of the permit. If, upon <br />the thirty first day after the expiration <br />of a permit, an application of renewal <br />has not been received, the permit shall <br />be deemed expired. Any permit issued <br />under this Chapter shall be returned to <br />the Police Chief within forty eight (48) <br />hours of its expiration. No privilege to <br />provide massage shall exist until an <br />application for renewal has been grant- <br />ed. After a permit expires, a new appli- <br />cation may be filed. <br />C. Permits may be renewed every <br />two (2) years by filing an application <br />for renewal under penalty of perjury <br />updating information in the original <br />application provided to the Police <br />Chief. <br />D. Verification of continued mem- <br />bership, in good standing, of a State or <br />national professional association as de- <br />scribed in Section 6.24.050 of this <br />Chapter and verification that the per- <br />mittee has participated successfully in <br />continuing education programs consist- <br />ing of a minimum of twenty four (24) <br />hours of related coursework of which a <br />(Pleasanton 5-98) 160-6 <br />
