6.24.090 <br />3. The operation as proposed by the <br />applicant would not comply with all <br />applicable ordinances and laws, includ- <br />ing, but not limited to, the City's <br />building, health, and fire safety ordi- <br />nances; <br />4. The applicant has previously had a <br />massage establishment permit, massage <br />technician permit, or any similar li- <br />cense, certificate, or permit revoked by <br />the City or any public agency during <br />seven (7) years preceding the date of <br />the application; <br />5. The applicant has made a material <br />misrepresentation in the application or <br />supplementary material submitted with <br />the application; <br />6. The applicant has been successful- <br />ly prosecuted under the Red Light <br />Abatement Act (California Penal Code <br />section 11225 et seq.) or any similar <br />law in another jurisdiction during seven <br />(7) years preceding the date of the <br />application; or <br />7. The applicant has been convicted <br />of any of the offenses provided in sub- <br />section 6.24.060011 of this Chapter <br />during seven (7) years preceding the <br />date of the application. <br />8. The name proposed for the mas- <br />sage establishment suggests that any <br />service is available that is prohibited <br />under this Chapter. <br />C. The Police Chief shall give writ- <br />ten notice of the grounds for denial to <br />the applicant personally or by first class <br />mail, postage prepaid, at the address <br />provided in the application. The notice <br />shall advise the applicant of the right to <br />appeal the decision. (Ord. 1727 § 2, <br />1997) <br />6.24.100 Appeal: <br />The decision of the Police Chief may <br />be appealed to the City Manager by the <br />applicant through the following proce- <br />dure: <br />A. Within ten (10) days after mailing <br />of the notice of denial, the applicant <br />shall file with the City Clerk a written <br />request for an appeal hearing, which <br />states the specific grounds for appeal. <br />B. As soon as practicable after re- <br />ceiving the appeal, the City Clerk shall <br />set a date for the City Manager to hear <br />the appeal, which date shall be no less <br />than seven (7) days nor more than <br />thirty (30) days from the date the ap- <br />peal was filed. The City Clerk shall <br />give each appellant written notice of <br />the time and place of the hearing at <br />least five (5) days prior to the date of <br />the hearing, either by causing a copy of <br />the notice to be delivered to the appel- <br />lant personally or by certified mail <br />addressed to the appellant at the ad- <br />dress shown on the appeal. Continuanc- <br />es of the hearing may be granted by the <br />City Manager on request of the appel- <br />lant for good cause shown, or on the <br />City Manager's own motion. The hear- <br />ing shall be informal. At the hearing, <br />the City Manager shall hear the appel- <br />lant and any witnesses and shall deter- <br />mine the issue. Upon conclusion of the <br />hearing, the City Manager shall render <br />a decision and order which shall be <br />final.
