18.116.015 <br />erty owners shown on the last equalized <br />assessment roll as owning real proper- <br />ty within three hundred feet (300') of <br />the exterior boundaries of the site of <br />the proposed home boutique at least ten <br />(10) days prior to the date on which the <br />decision will be made on the use permit <br />application. <br />E. If a heazing is requested, a public <br />hearing before the zoning administrator <br />shall be held prior to a decision being <br />made. No public heazing shall be held <br />unless such a request is made. <br />F. The use permit may be revocable <br />or granted subject to such conditions as <br />the zoning administrator may prescribe. <br />Conditions may include, but shall not <br />be limited to: <br />1. Requiring that no structural alter- <br />ations be made to the structure in order <br />to accommodate the home boutique; <br />2. A maximum of four (4) signs, not <br />less than four hundred feet (400') apart, <br />and each sign no more than six (6) <br />square feet in area. These signs shall <br />not be placed, used or maintained in <br />any location upon public property, <br />rights of way or within public ease- <br />ments, where such placement endangers <br />the safety of persons or property, or <br />unreasonably interferes with or impedes <br />the flow of traffic or the ingress or <br />egress from any residence or business. <br />These signs may be displayed no longer <br />than the permitted hours of operation of <br />the home boutique they are advertising; <br />3. A maximum of eight (8) hours of <br />operation in a single day, with the spe- <br />cific hours as proposed by the boutique <br />operators and as proposed in notices to <br />surrounding property owners; <br />4. Requiring all boutique members to <br />have a city business license. <br />G. The planning commission may <br />elect to review a decision of the zoning <br />administrator as described in section <br />18.144.020 of this title, or a decision of <br />the zoning administrator may be ap- <br />pealed to the planning commission by <br />the applicant or by any other person <br />described in section 18.144.020 of this <br />title. An appeal shall be heazd and <br />acted upon as described in sections <br />18.144.030 and 18.144.040 of this title. <br />(Ord. 1434 § 1, 1989) <br />18.116.020 Temporary Uses In C <br />District: <br />A. A temporazy use in an existing <br />structure may be permitted in a C dis- <br />trict, for not to exceed one yeaz where <br />it appears by specific finding made by <br />the planning commission that: <br />1. The temporazy use is proposed <br />only pending application for rezoning <br />to accommodate a permitted or condi- <br />tionally permitted use. The permit may <br />be conditioned upon the filing of such <br />application; <br />2. The temporary use, even though <br />not permitted or conditionally permit- <br />ted, is not so inconsistent with the <br />regulations for the district in which it is <br />located as to constitute a traffic hazazd <br />or parking problem, or to create noise, <br />odor, or other conditions offensive to <br />the senses, or to be inconsistent with <br />the adjoining land uses. <br />B.
