18.20.010 <br />13. All covered front porches that are <br />located in the front yard setback area in <br />the R-1, RM zoning districts and PUD <br />zoned residential properties referencing <br />the R-1/RM development standards of <br />this code. <br />14. Small electricity generator facili- <br />ties, and small fuel cell facilities. <br />The zoning administrator may refer <br />any of the above items to the planning <br />commission for review and action. <br />C. Modifications or deviations from <br />an approved plan, if deemed substantial <br />by the zoning administrator, shall be re- <br />viewed in accordance with the proce- <br />dures for the original use or structure <br />classification. <br />D. The zoning administrator may <br />waive review altogether or administra- <br />tively process an application if: <br />1. A new or modified use or struc- <br />ture shall not be visible from any pub- <br />lic street or area held open to the pub- <br />lic; or <br />2. For photovoltaic facilities, the <br />facilities shall adhere to the following <br />conditions: <br />a. The photovoltaic panels or shin- <br />gles shall be mounted flat on the roof <br />surface of a single-family detached <br />house, second unit, patio cover, trellis, <br />and/or carport (including office, com- <br />mercial, industrial, and public and <br />institutional patio covers, trellises, and <br />carports). <br />b. The photovoltaic facilities, includ- <br />ing all related accessory equipment, <br />shall comply with all locational and <br />height requirements of this title, includ- <br />ing setback regulations. <br />c. The photovoltaic facilities shall <br />not create adverse glare that distracts <br />motorists. <br />d. If photovoltaic panels are pro- <br />posed, the panels (including visible <br />trim caps and returns) shall be black, <br />clear, blue, gray or the same color as <br />the roof on which they are mounted. <br />e. If photovoltaic shingles are pro- <br />posed, the shingles shall comply with <br />any roof color regulations for the sub- <br />ject property. <br />If the installation of a photovoltaic <br />facility creates glare that distracts mo- <br />torists after it has been installed, at the <br />discretion of the zoning administrator, <br />the photovoltaic facility may be subject <br />to design review even if the facility <br />was exempt from design review prior to <br />its installation. In making decisions, approve, ap- <br />prove with modifications or conditions, <br />or deny an application. <br />B. Require such improvements, ei- <br />ther on or off site, which are reasonably <br />related to the project and are in the best <br />interests of the public health, safety, or <br />general welfare, or which are necessary <br />in order to mitigate adverse environ- <br />mental effects disclosed in an environ- <br />(Pleasanton January 2004) 494 <br />
