13.08.080 dog in a park and recreation facility ex- cept as provided in section 7.16.010 of this code and except as provided in subsection B of this section. B. Dogs shall be leashed at all times in any picnic area, gathering site, or irrigated lawn area of the Augustin Bernal park. A dog, except a dangerous dog, shall be permitted to be off a leash in an undeveloped area, not within one hundred feet (100') of a developed area, provided the dog is under the control of an individual responsible for the dog. The individual in control of or responsible for a dog shall place the dog's waste in a garbage receptacle if the waste is in a developed area or within one hundred feet (100') thereof. For purposes of this subsection, the fol- lowing definitions shall apply: 1. A "dangerous dog" means: a. Any dog which, when unprovoked, inflicts a bite, or attacks a human being or domestic animal, either on public or private property, or in a vicious or terrorizing manner, approaches any person in an apparent attitude of attack upon the streets, sidewalks, or any public grounds or places; or b. Any dog which has a known pro- pensity, tendency or disposition to attack unprovoked, to cause injury, or to otherwise endanger the safety of human beings or domestic animals; or c. Any dog which engages in, or is found to have been trained to engage in, exhibitions of dogfighting; or d. Any dog at large found to attack, menace, display threatening or aggres- sive behavior or otherwise threaten or endanger the safety of any domestic animal or person. 2. "Dangerous dog" does not mean any dog in a situation in which it is shown that the person or domestic animal which had been attacked, threat- ened or menaced had: a. Provoked, tormented, teased, or abused the dog into the behavior al- leged; or b. Committed a wilful trespass or other tort or crime upon the private property of the owner or person in control of the dog; or c. Threatened or committed an un- provoked assault or battery against the owner or person in control of the dog. 3. A "dog is under the control of an individual" if the dog is within fifty feet (50') of the individual at all times. 4. A "developed area" shall mean an irrigated lawn area, parking lot or road- way. 5. An "undeveloped area" shall mean all other areas of the Augustin Bernal park.
