13.08.080 <br />dog in a park and recreation facility ex- <br />cept as provided in section 7.16.010 of <br />this code and except as provided in <br />subsection B of this section. <br />B. Dogs shall be leashed at all times <br />in any picnic area, gathering site, or <br />irrigated lawn area of the Augustin <br />Bernal park. A dog, except a dangerous <br />dog, shall be permitted to be off a leash <br />in an undeveloped area, not within one <br />hundred feet (100') of a developed <br />area, provided the dog is under the <br />control of an individual responsible for <br />the dog. The individual in control of or <br />responsible for a dog shall place the <br />dog's waste in a garbage receptacle if <br />the waste is in a developed area or <br />within one hundred feet (100') thereof. <br />For purposes of this subsection, the fol- <br />lowing definitions shall apply: <br />1. A "dangerous dog" means: <br />a. Any dog which, when unprovoked, <br />inflicts a bite, or attacks a human being <br />or domestic animal, either on public or <br />private property, or in a vicious or <br />terrorizing manner, approaches any <br />person in an apparent attitude of attack <br />upon the streets, sidewalks, or any <br />public grounds or places; or <br />b. Any dog which has a known pro- <br />pensity, tendency or disposition to <br />attack unprovoked, to cause injury, or <br />to otherwise endanger the safety of <br />human beings or domestic animals; or <br />c. Any dog which engages in, or is <br />found to have been trained to engage <br />in, exhibitions of dogfighting; or <br />d. Any dog at large found to attack, <br />menace, display threatening or aggres- <br />sive behavior or otherwise threaten or <br />endanger the safety of any domestic <br />animal or person. <br />2. "Dangerous dog" does not mean <br />any dog in a situation in which it is <br />shown that the person or domestic <br />animal which had been attacked, threat- <br />ened or menaced had: <br />a. Provoked, tormented, teased, or <br />abused the dog into the behavior al- <br />leged; or <br />b. Committed a wilful trespass or <br />other tort or crime upon the private <br />property of the owner or person in <br />control of the dog; or <br />c. Threatened or committed an un- <br />provoked assault or battery against the <br />owner or person in control of the dog. <br />3. A "dog is under the control of an <br />individual" if the dog is within fifty <br />feet (50') of the individual at all times. <br />4. A "developed area" shall mean an <br />irrigated lawn area, parking lot or road- <br />way. <br />5. An "undeveloped area" shall mean <br />all other areas of the Augustin Bernal <br />park. (Ord. 1595 § 1, 1993; Ord. 1428 <br />§ 4, 1989) <br />13.08.090 Sale Of Goods - <br />Exhibitions: <br />No person shall sell any goods and <br />no person shall conduct or maintain any <br />show, performance, concert, place of <br />amusement or exhibition without the <br />written permission of the director. (Ord. <br />1428 § 4, 1989) <br />13.08.100 Advertising: <br />No person shall place or affix any <br />handbills, circulars, pamphlets, or ad- <br />vertisement to any tree, fence, shrub or <br />structure.
