19.44.040 <br />zoned for one dwelling unit per parcel. <br />When all or part of the subdivision is <br />located in an area zoned for more than <br />one dwelling unit per parcel, the num- <br />ber of proposed dwelling units in the <br />area so zoned shall equal the maximum <br />allowed under that zoning unless plans <br />have been approved by the city council <br />which show a different number. In the <br />case of a condominium project, the <br />number of new dwelling units shall be <br />the number of condominium units. The <br />term "new dwelling unit" does not <br />include dwelling units lawfully in place <br />prior to the date on which the parcel or <br />final map is filed. <br />E. The subdivider shall, without <br />credit: <br />1. Provide half street improvements <br />and utility connections as required <br />which shall include, but not be limited <br />to, curbs, gutters, street paving, traffic <br />control devices, street trees, and side- <br />walks to land which is dedicated pursu- <br />ant to this section. <br />2. Provide improved drainage <br />through the site; <br />3. Provide a fence or wall, if located <br />next to an existing or a planned resi- <br />dential area; and <br />4. Provide other minimal improve- <br />ments which the city engineer and <br />director of parks and community ser- <br />vices determines to be essential to the <br />acceptance of the land for recreational <br />purposes. <br />F. A preliminary plan showing loca- <br />tion details to the satisfaction of the <br />director of parks and community ser- <br />vices shall be submitted prior to subdi- <br />vision of land or approval of a project. <br />Also, the director of parks and com- <br />munity services shall approve the site <br />for suitability of the land to be dedicat- <br />ed and the improvements to be made <br />pursuant to this section. General Formula: If there is no <br />park or recreation facility designated as <br />"parks and recreation" on the general <br />plan map or which is not in confor- <br />mance with the general plan policies <br />and to be located in whole or in part <br />within the proposed subdivision to <br />serve the immediate and future needs of <br />the residents of the subdivision, the <br />subdivider shall, in lieu of dedicating <br />land, pay a fee equal to the value of <br />that land which would be required to be <br />dedicated, plus costs of off site im- <br />provements, prescribed for dedication <br />in section 19.44.040 of this chapter and <br />in an amount determined in accordance <br />with the provisions of section <br />19.44.070 of this chapter, such fee to <br />be used for a local park which bears a <br />reasonable relationship to serve the <br />present and future residents of the area <br />being subdivided or approved for devel- <br />opment. For the purposes of this chap- <br />ter, "off site improvements" are defined <br />as those improvements which would <br />have been required if land had been <br />dedicated using the provisions of sec- <br />tion 19.44.040 of this chapter. <br />B.
