Noncompliance: If the green build- ing compliance official determines that the applicant has not made a good faith effort to comply with this chapter, or if the applicant fails to submit the documen- tation required by subsection C 1 of this section within the required time period, then the final building approval and/or occupancy permit may be withheld. The green building compliance official may require additional reasonable green build- ing measures as authorized in subsection D3 of this section to be employed in the operation of the covered project to miti- gate the applicant's failure to comply with this chapter. Once the applicant has per- formed such additional reasonable green building measures, the green building compliance official shall approve the covered project for final building approval and/or issuance of an occupancy permit. If the documentation submitted by the applicant as required by subsections C2 and C3 of this section reveals that the applicant has not made a good faith effort to maintain the originally approved con- servation and energy related credits in the operation of the building, the green build- ing compliance official may require addi- tional reasonable green building measures as authorized in subsection D3 of this section. 3. Mitigation: If the green building compliance official determines that the applicant has not complied with this chap- ter, the green building compliance official may require further reasonable green building measures to be employed in the operation and maintenance of the covered project to mitigate the applicant's failure to comply fully with this chapter. Such mitigation measures may include, but are not limited to, landscaping the covered project to decrease water and energy consumption, use of energy efficient fixtures, including the use of energy effi- cient light bulbs, and education of the building's occupants and owners regard- ing on going energy and resource savings techniques. E. LEEDT'" Certification: For covered projects that have voluntarily registered with the U.S. green building council with the intent to certify the building at the "certified" level or above, the green build- ing compliance official may reduce the scope of the city's compliance review. Depending on the timing of certification, the documentation required by subsections C1, C2 and C3 of this section may be reduced or eliminated. Exemption: If an applicant for a covered project believes that circumstanc- es exist that make it a hardship or infeasi- ble to meet the requirements of this chap- ter, he or she may apply for an exemption as set forth below. In applying for an ex- emption, the burden is on the applicant to show hardship or infeasibility. B. Application: If an applicant for a covered project believes such circum- stances exist, the applicant may apply for an exemption at the time that he or she submits the prepermitting documentation required under section 17.50.050 of this chapter.
