CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-288 <br /> <br /> RESOLUTION APPROVING A MODIFICATION TO <br /> CONDITION NO. 10 FOR TRACT 5835, VINTAGE <br /> HEIGHTS, TO AT.T~W OCCUPANCY PRIOR TO <br /> FINAL ACCEPTANCE OF TRACT IMPROVEMENTS <br /> <br />WHEREAS, at its meeting of June 20, 1989, the City Council <br /> reviewed the report of the Director of Planning and <br /> Community Development (SR 89:283) regarding a <br /> request to allow occupancy prior to final <br /> acceptance of tract improvements; and <br /> <br />WHEREAS, the proposed modification would allow occupancy to <br /> the subject tract so long a security satisfactory <br /> to the City Attorney has been posted to cover the <br /> estimated cost of the "punch list" items prior to <br /> City Council acceptance of the subdivision and so <br /> long as the subdivision is cleaned up to meet <br /> safety requirements for public access and use of <br /> streets, sidewalks, etc.; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves a modification to condition number 10 of <br /> Tract 5835 to allow occupancy prior to final <br /> acceptance of Tract improvements, subject to the <br /> following: <br /> <br /> a. Security, satisfactory to the City Attorney, <br /> in an amount estimated by the Engineering <br /> Division to cover all "punch list" items <br /> remaining in the tract shall be delivered to <br /> the City Engineer prior to any building being <br /> finaled and/or house occupancy given to any <br /> house within the subdivision; and <br /> <br /> b. All tract sidewalks and streets within the <br /> subdivision shall be cleared prior to <br /> occupancy of any unit within the subdivision. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
