CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-280 <br /> <br /> RESOLUTION DENYING CASE PUD-85-8-4D, THE <br /> APPLICATION OF RETAIL PROPERTY <br /> DEVELOPMENT COMPANY <br /> <br />WHEREAS, Retail Property Development Company has applied for <br /> design review approval to construct a two-building, <br /> approximately 35,900 sq. ft. retail commercial <br /> complex to be located on the north side of Owens <br /> Drive approximately 400 feet east of the <br /> intersection of Chabot Drive and Owens Drive; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared for the <br /> development plan of the subject site including the <br /> typical architectural and site designs for <br /> individual lots, and there are no changed <br /> circumstances or new information requiring <br /> additional environmental review; therefore, this <br /> application does not constitute a new project under <br /> CEQA and no new environmental documents accompany <br /> this application; and <br /> <br />WHEREAS, a public hearing was held on June 20, 1989 and <br /> testimony taken concerning the proposed project <br /> including its design, cumulative impact, <br /> consistency with the zoning and the General Plan; <br /> and <br /> <br />WHEREAS, members of the City Council expressed concern <br /> regarding the appropriateness of the use for this <br /> site and the excess floor area ratio; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the application of Retail Property <br /> Development Company for design review approval to <br /> construct a two-building, approximately 35,900 sq. <br /> ft. retail commercial complex to be located on the <br /> north side of Owens Drive approximately 400 feet <br /> east of the intersection of Chabot Drive and Owens <br /> Drive. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
