Chairperson Arkin believed the open space would be deeded to the City. <br /> <br /> <br />Ms. Decker noted that there will be an inevocable offer of dedication to the City, and the <br />City would make the decision about the timing of taking possession of those lands. <br />Commissioner Olson believed the transfer of the open space to the City should be <br />clazified before the Final Map stage of the project. He noted that if he were a prospective <br />homeowner on this property, the possibility of maintaining 500 acres of open space <br />would concern him a great deal. <br />Lee Fulton, 3407 Bradley Court, reiterated his previous comments made at the July 12, <br />2006 meeting with respect to the inadequacy of the visuals and to additional views being <br />taken from specific neighborhoods in the area such as from Matazo Court, Grey Eagle <br />Court, Vintage Hills, Vintage Hills II, and the Busch Property. He expressed concern <br />that the pazklands that they had been promised would not be accessible to the public <br />without having a staging area from the Hearst Drive side. He noted that would be a long <br />hike from the other side. He did not believe the neighbors would like people parking in <br />front of their homes in order to hike the trail. <br />Glen Fiderko, 3561 Crespi Court, expressed concern about the visual impacts of the <br />development on his views. He did not want dirt to be dumped in the canyon as occurred <br />during the building of Kottinger Ranch project, which led to an erosion problem. He <br />noted that the canyon acts as an acoustic funnel, and was concerned about noise <br />abatement during construction. <br />THE PUBLIC HEARING WAS CLOSED. <br />In response to an inquiry by Commissioner Fox regarding where the preferred location <br />for a staging area would be, Mr. Inderbitzen replied that the Draft EIR identified a <br />number of potential staging azeas. He believed one of the proposed sites was neaz the <br />water tank. <br />In response to an inquiry by Commission Fox regarding whether this would be a gated <br />community, Mr. Inderbitzen noted that the City prohibited gates through a General Plan <br />policy. He noted that there had not been as lazge a gift of land as this occurrence, which <br />brought many questions to the forefront. He noted that there was plenty of time in the <br />future to address the pazks and trails issues which did not relate to the environmental <br />impact. He noted that they were dedicated to mitigating the traffic impacts in <br />conjunction with the Heazst Drive residents. <br />In response to an inquiry by Commissioner Olson regazding whether the project had the <br />support of the residents, Mr. Inderbitzen replied that he could not answer for all the <br />neighbors but hoped they would present their opinions during the PUD heazings. <br />PLANNING COMMISSION MINUTES August 23, 2006 <br />Page 14 of 17 <br />
