` United Growth Buildine <br />Chairperson Arkin noted that this building still had the notch in it, although two <br />businesses have since opened near it. Ms.'Decker noted that Subway was issued a <br />temporary occupancy permit. She noted that the developer, Mr. Parrague, had deposited <br />funds and had committed to getting the louvers in the walls; the walls were under <br />construction. She noted that the wall was under construction, and the trellis will be <br />modified to go around the door. In addition, the equipment cabinet will be placed on the <br />exterior so the conduit would not show. No additionally temporary certificates of <br />occupancy would be issued, although building permits for the tenant improvements will <br />continue to be issued. <br />Commissioner Blank suggested agendizing an item to hold a public heazing to determine <br />whether the businesses had violated the conditions of their occupancy. <br />Commissioner Maas noted that the City had given those temporazy certificates of <br />occupancy. <br />Commissioner Blank would like the businesses to show that they will uphold the <br />conditions of the temporazy certificate of occupancy and that agendizing the item will <br />show the Commission's seriousness regarding this matter. If the matter has been fixed <br />before the hearing, it could be pulled off the agenda. <br />Ms. Decker advised that she would present this issue to the City Attorney's office. <br />Commissioner Fox expressed concern about the safety of the occupants. <br />Ms. Decker noted that the louvers were not life-safety issues. <br />Commissioner Blank hoped to motivate the building owner to complete the work. <br />Ms. Decker noted that the agreement was that the work would be completed by <br />February 24, 2006. <br />Commissioner Maas expressed concern that she had met with the developers at the City <br />offices, and they had not done as they promised. <br />Commissioner Fox noted that the City had been very flexible with them in the past. <br />There was Commission consensus that the project be placed on the agenda and brought <br />back to the Planning Commission to begin the process to revoke the conditional use <br />permit and the temporary certificate of occupancy. <br />Activitv at Foothill Road/Stoneridee Drive <br />Chairperson Arkin noted that construction appeared to be occurring at this site. <br />PLANNING COMMISSION MINUTES February 22, 2006 Page 19 of 21 <br />
