~ Commissioner Blank moved to make the required conditional use findings as listed <br />in the staff report and to approve PCUP-149, subject to the conditions of approval <br />as listed on Exhibit B of the staff report, as recommended by staff, with the addition <br />of a condition of approval that the applicant confirm that the facility is exempt from <br />childcare licensing requirements and obtain a written confirmation of the exemption <br />prior to occupancy. <br />Chairperson Maas seconded the motion. <br />Commissioner Fox indicated that she preferred a continuance until the letter could be <br />obtained by the applicant. <br />ROLL CALL VOTE: <br />AYES: Commissioners Arkin, Blank, Maas, and Pearce. <br />NOES: Commissioner Fox. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: Commissioner Roberts. <br />Resolution No. PC-2006-04 was entered and adopted as motioned. <br />d. <br />Application for PUD design review approval to construct atwo-story, <br />~" 24,600-square-foot office building on a vacant 1.37-acre site located at <br />4733 Chabot Drive in the Hacienda Business Park. Zoning for the property is <br />PUD-I/C-O (Planned Unit Development -Industrial/Commercial-Office) District. <br />Ms. Decker summarized the staff report and reviewed the history and scope of the <br />project. She noted that the project was the same one previously reviewed and approved <br />by the Planning Commission, with the exception that the staff report has addressed <br />outdated information related to the green building and storm water requirements that aze <br />now in place. The design is the same as that approved and expired for failure to activate <br />the entitlement by pulling out the building permit. A memo from staff was attached to <br />the staff report relating several changes; the project description stated the building would <br />have split-face masonry columns, which in fact would be color concrete. Also, Condition <br />No. 22 has been added to the site plan section relating to the trash enclosure that has been <br />relocated outside the easement azeas. Staff recommended approval of this item. <br />In response to an inquiry by Chairperson Arkin regazding the inclusion of "Palm Event <br />Center" in the LEED scorecard, Ms. Decker replied that was not correct, and that prior to <br />submittal, the applicant will submit the appropriate LEED checklist to staff. <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />PLANNING COMMISSION MINUTES January 25, 2006 Page 8 of 19 <br />
