ATTACHMENT A <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING A JOINT POWERS AGREEMENT FORMING THE EAST BAY <br />REGIONAL COMMUNICATIONS SYSTEM AUTHORITY AND APPROVING AND <br />DIRECTING THE FILING OF A "NOTICE OF EXEMPTION" PURSUANT TO THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT <br />WHEREAS, the Pleasanton City Council has reviewed the proposed joint powers <br />agreement forming the East Bay Regional Communications System Authority (the <br />"Agreement"); and <br />WHEREAS, the Pleasanton City Council concurs in the recitals of the Agreement; and <br />WHEREAS, the Pleasanton City Count desires to approve the Agreement forming the <br />East Bay Regional Communications System Authority (the "Authority"); and <br />WHEREAS, the approval of the Agreement has been reviewed in accordance with the <br />provisions of the California Environmental Quality Act (CEQA) and has been found to be <br />categorically exempt pursuant to CEQA Guidelines Section 15320 relating to changes in the <br />organization of local agencies. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />Section 1: The Agreement forming the Authority, attached hereto as Exhibit A, is hereby <br />approved and the City Manager is hereby authorized to execute it on behalf of the City. <br />Section 2: The Notice of Exemption pursuant to the CEQA relating to the approval of the <br />Agreement, attached hereto as Exhibit B, is hereby approved. The City Manager is hereby <br />authorized to execute the Notice of Exemption on behalf of the City, and is directed to file it in <br />accordance with CEQA Guidelines Section 15062. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br />a regular meeting held on July 17, 2007. <br />I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the , by the <br />following vote: <br />Ayes: <br />Noes: <br />Absent: <br />Abstain: <br />Karen Diaz, City Clerk <br />APPROVED AS TO FORM: <br />Michael H.
