(c) Owner agrees to pay an amount computed in accordance <br /> with the applicable City formula for connection to <br /> water facility improvements subject to a mutual <br /> benefit district, reimbursement agreement, or any <br /> other agreement. <br /> <br /> (d) Owner agrees to pay a monthly water service charge as <br /> is now or may hereafter be specified by ordinance. <br /> <br /> (e) Owner agrees to abandon and seal the existing water <br /> well on the property to the satisfaction of the City <br /> Engineer. <br /> <br /> 2. Aareement to Annex. Owner agrees to consent to annex to <br />the City of Pleasanton all those lands described herein at such <br />time as City may require. Owner and City agree that the <br />provisions of this Agreement, State and County laws, and City <br />ordinances and resolutions shall control the responsibilities of <br />both parties at the time of annexation. Owner further agrees to <br />cooperate with City in the annexation of the lands described <br />herein, whether alone or as part of a larger area, and expressly <br />waives the right to protest said annexation and agrees to do no <br />act calculated or tending to prevent, impede, or defeat the <br />successful annexation of said property. <br /> <br /> 3. Land Subject to This Aqreement. The land subject to this <br />Agreement shall be those lands of Owner, more particularly <br />described in legal description and map attached hereto as <br />Exhibit A and made a part hereof. <br /> <br /> 4. Bonded Debt. Owner does hereby consent that, upon <br />annexation of his property to City, said property shall be taxed <br />to pay its share of existing bonded indebtedness of City. This <br />Agreement shall serve as such consent, and a copy shall be filed <br />with Treasurer-Tax Collector of Alameda County, if evidence of <br />such consent is required; provided, however, that Owner's property <br />will be excluded from the City bonded debt existing on the <br />effective date of this Agreement and from and after the annexation <br />of his property to City for all utility facilities to which <br />Owner's property is not connected. <br /> <br /> 5. Taxes. Owner understands that after annexation has been <br />completed said property shall be subject to all real property <br />taxes. <br /> <br /> 6. Assessment Districts. Owner agrees to cooperate with City <br />in the formation of any mutual benefit districts or assessment <br />districts which City deems necessary for the installation of <br />public improvements serving, in whole or in part, Owner's lands as <br />described herein, whether such districts are formed at the time of <br />annexation or some time in the future. In this regard, Owner <br />waives the right to protest the formation of any of said districts <br />and agrees to do no act calculated or tending to prevent, impede, <br />or defeat the successful formation thereof; provided, however, <br /> <br /> <br />
