CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 89-255 RESOLUTION DENYING THE APPEAL OF THE CITY COUNCIL OF A DECISION OF THE PLANNING COMMISSION APPROVING CASE UP-89-21, THE APPLICATION OF SPIEKER PARTNERS WHEREAS, at its meeting of May 10, 1989 the Planning Commission approved the application of Spieker Partners for a conditional use permit to operate a food market in Rose Pavilion, a retail shopping center located at the northeast corner of Rosewood Drive and Santa Rita Road as filed under Case UP-89-21; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council submitted an appeal to the City Clerk of the City of Pleasanton; and WHEREAS, a public hearing was held before the City Council on June 6, 1989 at which time all pertinent testimony and documents were reviewed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council denies appeal AP-89-4, thus upholding the decision of the Planning Commission approving Case UP-89-21, the application of Spieker Partners for a conditional use permit to operate a supermarket within a retail commercial complex (Rose Pavilion Shopping Center) to be located at the northeast corner of the intersection of Rosewood Drive and Santa Rita Road, subject to the following conditions: 1. The use shall be operated as a regionally- oriented, no-frills supermarket, as described in the letter from Mr. Clute to the Planning Department dated 4/28/89 and on file in the record of this case; 2. The use shall be subject to allrelevant conditions of approval for Case Z-89-142; and 3. A review of the 24-hour operation may be held at a later time.
