CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-255 <br /> <br /> RESOLUTION DENYING THE APPEAL OF THE CITY <br /> COUNCIL OF A DECISION OF THE PLANNING <br /> COMMISSION APPROVING CASE UP-89-21, THE <br /> APPLICATION OF SPIEKER PARTNERS <br /> <br />WHEREAS, at its meeting of May 10, 1989 the Planning <br /> Commission approved the application of Spieker <br /> Partners for a conditional use permit to operate a <br /> food market in Rose Pavilion, a retail shopping <br /> center located at the northeast corner of Rosewood <br /> Drive and Santa Rita Road as filed under Case <br /> UP-89-21; and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the City Council submitted an <br /> appeal to the City Clerk of the City of Pleasanton; <br /> and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on June 6, 1989 at which time all pertinent <br /> testimony and documents were reviewed. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council denies appeal AP-89-4, thus <br /> upholding the decision of the Planning Commission <br /> approving Case UP-89-21, the application of Spieker <br /> Partners for a conditional use permit to operate a <br /> supermarket within a retail commercial complex <br /> (Rose Pavilion Shopping Center) to be located at <br /> the northeast corner of the intersection of <br /> Rosewood Drive and Santa Rita Road, subject to the <br /> following conditions: <br /> <br /> 1. The use shall be operated as a regionally- <br /> oriented, no-frills supermarket, as described <br /> in the letter from Mr. Clute to the Planning <br /> Department dated 4/28/89 and on file in the <br /> record of this case; <br /> <br /> 2. The use shall be subject to allrelevant <br /> conditions of approval for Case Z-89-142; and <br /> <br /> 3. A review of the 24-hour operation may be held <br /> at a later time. <br /> <br /> <br />
