CONTRACT FOR CONSULTANT SERVICES <br /> <br /> MAIN STREET DESIGN AND DEVELOPMENT PLAN <br /> <br />THIS AGREEMENT is made and entered into this day of , <br />by and between the CITY OF PLEASANTON, a municipal corporation (hereinafter <br />referred to as "City"), and Freedman, Tung, anti 80tt0rnl ey (hereinafter referred to <br />as "Consultant"). <br /> <br /> WITNESSNETH: <br /> <br /> A. Consultant is qualified to provide, and experienced in providing, <br /> urban planning and design services and has offered its services for <br /> the purposes specified in this Agreement. <br /> <br /> B. In the judgement of the City, it is necessary and advisable to employ <br /> the services of Consultant for the purpose of undertaking their <br /> planning and design services. <br /> <br />NOW, THEREFORE, in consideration of the mutual covenants, agreements and <br />conditions contained herein, City and Consultant agree as follows: <br /> <br /> 1. Consultant's Services. Consultant shall diligently perform the services <br /> and furnish the materials, reports, maps and so forth as hereinafter <br /> set forth: <br /> <br /> a. Consultant shall perform all work described in Exhibit "A", <br /> Scope of Work, attached hereto and incorporated herein by this <br /> reference. <br /> <br /> b. Consultant shall meet with the technical staff of the City, other <br /> pertinent agencies, and/or landowners as necessary to complete <br /> scope of work outlined in Section 1 (a) herein. <br /> <br /> 2. City Services. In order to assist Consultant in this study, City shall <br /> provide any existing plans of the area on file and necessary direction <br /> within a reasonable time. <br /> <br /> 3. Sufficiency of Consultant's Work. Consultant agrees that all reports, <br /> maps, and plans prepared for the City shall be adequate and <br /> sufficient to meet the purposes for which they are performed. <br /> <br /> 4. Ownership of Work. All maps, reports, work data, and all other <br /> documents completed or partially completed by Consultant in the <br /> performance of this Agreement shall become the property of City. <br /> <br /> <br />
