CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-230 <br /> <br /> RESOLUTION VACATING EASEMENTS FOR 1-680 <br /> SOUNDWALLAND AUTHORIZING DIRECTOR OF <br /> PUBLIC WORKS TO EXECUTE QUITCLAIM DEEDS <br /> <br />WHEREAS, in November 1981, the City entered into an <br /> agreement with Caltrans to design and construct two <br /> soundwalls easterly of 1-680; and <br /> <br />WHEREAS, in conjunction with this project, the City obtained <br /> easements to construct the soundwall from various <br /> landowners; and <br /> <br />WHEREAS, the easements obtained for the soundwall is not <br /> required and have never been used since their <br /> dedication; and <br /> <br />WHEREAS, in order to comply with Caltrans' procedures, it is <br /> necessary to make adjustments in the steps already <br /> taken by the City; and <br /> <br />WHEREAS, the City Attorney presented his report (SR 89:259) <br /> regarding the necessary steps to be taken and the <br /> form for documents; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing <br /> that the easement has not been used and is not <br /> required pursuant to Section 8335 of the Streets <br /> and Highways Code, the public service easements <br /> described in Exhibit "A" are hereby vacated. <br /> <br />Section 2: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the Office <br /> of the Alameda County Recorder. <br /> <br />Section 3: That from and after the date the resolution is <br /> recorded, the street, highway, soundwall easement, <br /> or public service easement vacated no longer <br /> constitutes a street highway, soundwall easement, <br /> or public service easement. <br /> <br />Section 4: Approves the attached form of Quitclaim of the <br /> City's interest in the soundwall easements. <br /> <br /> <br />
