6. If PGS ceases to b~ the City's franchisee, costs of the
<br />landfill closure including ongoing monitoring shall remain the
<br />responsibility of PGS provided, however, the City shall require
<br />that the subses~uent rranchisor shall reimburse ongoing cosLS of
<br />landfill closure to PGS from then existing garbage rst+=_s.
<br />In the alternative, at the time of termination of the ?GS
<br />franchise, City shall have the option to purchase tr.e landii:.l
<br />site at the then appraised value minus the accumuliated costs o~
<br />the landfill closure, provided however, the Gity's option pri:.e
<br />shall nat be less than ~zventy-seven Thousand Eigrit Hundrad
<br />Seventy-six and t1o/100 Dt~llars ($77, 876.00} .
<br />7. In the event of litigation to enforce this agree^~ent,
<br />the prevailing party shall be entitled to reasonably attorneyts
<br />fees.
<br />8. This agreement may be recorded in the Office of the
<br />County Recorder of Alameda county. '
<br />9. This agreement shall become effective immediately upon
<br />its execution.
