-- <br />Commissioner Gibbs questioned this last statement. Ne disagreed, stating that the <br />intent of the Commission was quite clear but that the developer now wants the <br />Commission "to take his chestnuts out of the fire for him." Commissioner Gibbs <br />again emphasized that he and several of the Co®isaioners as well, did personally <br />talk to residents in the area. He also talked to the Chief of Police who <br />specifically stated that this situation should not be allowed. <br />Considerable discussion ensued. <br />.....:.Commissioner Gibbs then stated that he did not wish to be in the shoes of a <br />Commissioner who would vote for elimination of sidewalks and have the injury or <br />death of a child on his conscience because of it. <br />After still further discussion, the Chairman inquired of Ms. Hirst what kind of <br />reconsideration can be taken at this time. The City Attorney advised that any <br />revisions should be in the form of a resolution. Commissioner Antonini felt <br />that the modification in the resolution should be made by City Council. <br />Upon motion of Commissioner Pons, seconded by Chairman Garrigan, and carried, <br />the following resolution was offered: <br />RESOLUTION N0. 957 <br />WHEBEAS, the question of the elimination of sidewalks in <br />Valley Trails has been referred back by the <br />City Council to the Planning Commission for <br />clarification and/or reconsideration, and, <br />WHEREAS, the Planning Commission has further deliberated <br />said condition and the feasibility of it being <br />applicable at this point in time, and, <br />WHEREAS, the Planning Commission further reviewed a revised <br />tabulation prepared by D. 6 V. Builders of the <br />questionnaire mailed by the Planning staff and <br />where the final results of said survey indicate <br />a much closer yet inconclusive result of the <br />desires of the residents of Valley Trails, <br />NOW, TNEREFORB BE IT RESOLVED, that the Planning Commission hereby <br />amends its previous resolution regarding the <br />elimination of sidewalks for Valley Trails by <br />repealing Eesolution No. 954 and adopting <br />Resolution No. 957, with the following con- <br />ditions: <br />1. that the restrictions originally imposed by <br />Condition #17 of Resolution No. 763 be waived <br />for Units iPl and #2; <br />2. That Units #3 and #4 shall have sidewalks on <br />both sides of the street, said Units #1, #2, <br />#3 and #4 are hereby described on said attached <br />map labeled Exhibit A. <br />PASSED AND ADOPTED by the Planning Commission of the City of <br />Pleasanton on the 8th day of October, 1969, by <br />the following vote: <br />-7- <br />
