VII. ATTORNEY'S FEES <br /> <br /> If either party commences an action against the other to <br />enforce or interpret this agreement, the prevailing party <br />shall be entitled to have and recover reasonable attorney's <br />fees and costs of suit from the party not prevailing. <br />VIII. NOTICE <br /> <br /> Any notice or communication required or provided for <br />under this agreement shall be given in writing and sent by <br />ordinary mail to the following address: <br /> <br /> CITY: City of Pleasanton <br /> P. Box 520 <br /> Pleasanton CA 94566 <br /> <br /> OWNERS: <br /> <br /> Any notification required to be made by the City <br />Engineer shall also be sent to the party shown as the <br />property owner on the latest equalized assessor's roll. Any <br />party or successor in interest may change the foregoing <br />address by giving notice of a new address to each other <br />party in the manner herein provided. Notice shall be <br />considered received two days after the time of mailing. <br />IX. SUCCESSORS IN INTEREST <br /> <br /> This Agreement shall run with the land and be binding <br />upon any and all heirs, assigns, and successors in interest <br />of Owners having an interest in the property described in <br />Exhibit "A".
