RESOLUTION N0. 96 <br />Recommending to the City Council the Gran$ing of Variance on Application of Franh <br />Oufdermaur, Lot 15, Block 8, Tract 2007, Pleasanton, California, filed March 4, <br />1960, for relief from setback requirements required by un-repealed portions of <br />Ordinance No. 228, as amended. <br />The above described application, having been duly considered, pursuant to <br />Ordinance No. 228, as amended, of the City of Pleasanton, and good cause appearing; <br />NOW THEREFORE, the Planning Commission does hereby recommend as follows: <br />1) That public hearing has been duly held. <br />2) That the Planning Commission finds the conditions requiring such a <br />variance have been met. <br />3) That a VARIANCE is hereby recommended as follows: <br />Variance of 5' from required 20' setback from <br />Angela Street and Mirador Drive on Lot 15, <br />Block 8, Tract 2007 <br />4) That the Secretary is hereby instructed to forward copies of this <br />Resolution to the applicant, city officers and any other interested <br />parties. <br />At 8:5o P.M., Chairman Hanifen removed himself as a member of the quorum and turned the <br />meeting over to Commissioner Landon. <br />Ralph Pahlmeyer came before the Commission with his application for a Conditional Zoning <br />Permit to construct a Shell Service Station at the northeast corner of First and Angela <br />Streets. On motion of Commissioner Allison, seconded by Commissioner Lozano, RESOLUTIONi <br />N0. 97, granting the CONDITIONAL ZONING PERMIT under the following conditions, was passed: <br />RESOLUTION N0. 97 <br />Granting Conditional Zoning Permit on Application oP Ralph Pahlmeyer, northeast <br />corner of First and Angela Streets, Pleasanton, California, filed March 14, 1960, <br />for commercial use. <br />The above described application, having been duly considered, pursuant to <br />Ordinance No. 293, of the City of Pleasanton, and good cause appearing; <br />NOW THEREFORE, the Planning Commission does hereby resolve as follows: <br />1) That no public hearing is deemed necessary in the public interest in <br />this matter. <br />2) That the Planning Commission finds the conditions of Section 2.22 of <br />Ordinance No. 293 pertaining to co~mnercial uses have been met. <br />3) That a CONDITIONAL ZONING PERMIT is hereby granted fora period of six <br />(6) months, effective this date, subject to the fol]owing conditions: <br />a) To be constructed according to plans presented to tge Planning <br />Commission, subject to changes and recommendations made by the City <br />Engineer. <br />b) Construction to be surrounded on two sides by a 6' concrete block <br />fence. <br />c) That property outside a 2O' radius be dedicated to the City. <br />4) That the Secretary is hereby instructed to forward copies of this <br />Resolution to the applicant, city officers and any other interested <br />parties. <br />ROLL CALL: Ayes - Commissioners Allison, Lozano <br />Noes - Commissioner Tendon <br />Commissioner Tendon stated his reason for opposing this application due to the fact that <br />this area is zoned for two family dwellings under the Interim Zoning Ordinance and it <br />would be spot zoning. Commissioner Landon suggested that they discuss the possibility of <br />re-zoning the east side of First Street to a C-T zone, and the Commissioners present <br />
