MINUTE S <br />of <br />THE MEETING <br />of <br />THE PLANNING COMMISSION <br />Pleasanton, California <br />Julq 5, 1962 <br />The regularly scheduled meeting of the Planning Commission was called to order at <br />8:05 Y.M. on Thursday, July 5, 1462, by Chairman Pro Tempura Frank Lozano. <br />ROLL CALL showed the following: <br />PRESENT: Chairman Lozano <br />Commiesionara Antonini <br />Wipfli <br />Secretary Falea <br />ABSENT: Commissioners Landon <br />Rego <br />Ex Officio Dana <br />Huhn <br />Kamp <br />On motion of Commissioner Antonini, seconded by Commissioner Wipfli, the minutes <br />of the meeting of June 21 were approved as presented and unanimously adopted by <br />the Commissioners present. <br />Chairman Lozano reopened the public hearing on the request of Mre. Anna H. Brown, <br />581 Mitchell Ava., San Leandro, for an amendment to Ord. No. 309, redesignating <br />the property located at 484A and 484E Division Street from an R-1 (single-family' <br />residential) District to an RG-15 (residential garden apartment) District. (Con- <br />tinued from June 21, 1962.) Secretary Fales stated the staff was of the opinion <br />that the area west of Main St, bounded by Pleasanton Avenue, Bernal Avenue and St. <br />John Street should be rezoned to higher density, multiple residential usage, This <br />particular request of Mrs. Brown for rezoning lies within that area. Mr. Fales <br />recommended that at the aext meeting the Planning Commission consider rezoning s <br />larger area rather than spot zoning of this particular property. Attorney Struthers, <br />upon being asked if Mra. Brown is entitled to a decision on her property at this <br />time, stated that spot zoning is neither unlawful nor illegal, but Mra. Brown mat <br />make a decision whether or not she consents to a continuance of her application to <br />come before the Commission at the meeting of July 19. Mr. Vick Stuchlik, represent- <br />ing Mrs. Bruton, who was also in the audience, said she would agree to a continuance <br />and wait for a decision on a larger area surrounding her property. It was moved <br />by Commissioner Antonini, seconded by Coandsaioner Wipfli, and carried, that the <br />staff be instructed to take the necessary measures for the Commission to hold a <br />public hearing at the meeting of July 19 on rezoning a larger area from R-1 to R-15. <br />Chairman Lozano then reopened the public hearing on the request of Mr, Robert <br />Demeyer, 4421 Pleasanton Ave., for a variance from Section 6.5, Ord. No. 309, in <br />order to construct a carport in an R-1 (single-faffily residential) District. (Con- <br />ti:rued from June 21, 1962.) Mr. Demegar was preasat in the audience and subffitted <br />a revised drawing for Comffisaion consideration, Mr. Fales pointed out that accord- <br />ing to the revised drawing, Mr. Demeyer now requests a 5 ft. variance rather than <br />the original 10 ft, variance. On motion of Comsieaioner Wipfli, seconded bq Com- <br />ffiasioner Antonini, the following resolution was unanimously adopted: <br />RSSOLUZ~ON N0,-,,-,_176 <br />WHEREAS, the application of Mr. Robert Demeyer, 4421 Pleasanton Avenue, <br />for a variance of five feet from the front yard setback raquisa- <br />ments of Section 6.5, Ord, No. 309, to allow construction of a <br />carport. at 4421 Pleasanton Avenue, in an R-1 (single-family resi- <br />dential) District, having coma before this Comffiealoa on July 5, <br />1962, under Ord. No. 309, as amended, the Planning Commission <br />does hereby resolve as follows: <br />
