CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-524 <br /> <br /> RESOLUTION GRANTING THE APPEAL OF COLLEEN <br /> MCKEANANDALLOWINGRETENTION OFT HE SPA <br /> AND DECKAT 4341 KRAUSE STREET <br /> (AP-89-20/V-ag-27) <br /> <br />WHEREAS, Colleen McKean applied on behalf of Stephen Saward <br /> for a variance from the Municipal Code to allow <br /> retention of an existing spa which encroaches <br /> within the required rear yard setback and to allow <br /> the retention of a deck which exceeds the height <br /> requirements at the residence located at 4341 <br /> Krause Street; and <br /> <br />WHEREAS, at its meeting of November 8, 1989, the Board of <br /> Adjustment denied the applicant's request; and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the applicant submitted an appeal <br /> to the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, at its meeting of December 12, 1989, the City <br /> Council received a report from the Director of <br /> Planning and Community Development together with a <br /> copy of the Staff Report to the Board of Adjustment <br /> regarding this matter; and <br /> <br />WHEREAS, the City Council held a public hearing at which <br /> time applicant and any other member of the public <br /> was offered an opportunity to present evidence <br /> regarding this appeal; <br /> <br />WHEREAS, after a review of the material presented, the city <br /> Council makes the following findings: <br /> <br /> a. That there are special circumstances unique to <br /> the site. <br /> <br /> b. That the proposal will not constitute a grant <br /> of special privilege. <br /> <br /> c. That the health, safety and general welfare of <br /> the surrounding area are not jeopardized by <br /> the request. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> <br />
