1. that the proposed amendment will not be <br />contrary to the spirit and intent of the <br />General Plan. <br />2, that ~he proposed amendment is in the <br />public interest and general welfare. <br />3. that the proposed amendment will create a <br />more equitable condition for the com<aunity <br />than now prevails. <br />NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of <br />Pleasanton hereby recommends to the City Council <br />the adoption of Ordinance No. 520 establishing <br />Article 14, .,Civic Overiay District (C-0). <br />Upon request of Lee Amaral and participating individuals, the following matter <br />was moved up on the agenda with the approval of the Planning Commission. <br />11. REFERRALS FROM CITY COUNCIL <br />a. Consideration for the acquisition of additional land for property right-of- <br />wav. Tract 2892 (Longview) <br />Representatives for both parties - Dr. Howard Long and Mr. McLeod - feel <br />that an amicable arrangement might be worked out, and requested that the <br />Planning Commission continue the matter until the meeting of September 11, <br />1968. UPON MOTION OF COMMISSIONER PLATO, SECONDED BY COMMISSIONER GARRIGAN, <br />THE FOLLOWING RESOLUTION WAS ADOPTED BY UNANII~US VOTE. <br />RESOLUTION N0. 804 <br />WHEREAS, consideration for the acquisition of additional <br />land for property right-of-way, Tract 2892 <br />(Longview), has come before this Commission, <br />NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission hereby approved <br />that this matter be continued until September 11, <br />1968, pending further information from repre- <br />sentatives of both parties as to any arrangements <br />that may be resolved. <br />5. OLD BUSINESS (Continued) <br />e. UP-68-7 Tract 2948 - Sales Pavilion and Model Homes <br />Application of D 6 V Builders to construct the above sales pavilion and <br />model homes fronting on Hopyard Road. Chairman Antonini opened the Public <br />Hearing. Mr. Castro explained the plan submitted by the representative <br />of D & V Builders, Mr. Dudley Frost, to retain the existing parking for <br />employees. The existing sales office is a model home and will be sold. <br />Mr. Frost requested that Condition No. 2 of the staff report be changed <br />to show that parking be subject to approval of the Planning Department. <br />The reason for this is that moat people coming to visit models, park on <br />the frontage road as it is extremely long. There were no objections from <br />anyone in the audience. Upon motion of Chairman Antonini and seconded by <br />Commissioner Carrigan, and carried, the Public Hearing was closed. UPON <br />MOTION OF COMMISSIONER ARNOLD, SECONDED BY COMMISSIONER PLATO, THE <br />FOLLOWING RESOLUTION WAS ADOPTED BY UNANIMOUS VOTE. <br />RESOLUTION N0. 805 <br />WHEREAS, application of D 6 V Builders to construct the <br />above sales pavilion and model homes fronting <br />on Hopyard Road, has come before this Commission, <br />NOW, THEREFORE, BE IT RESOLVED, that UP-68-7 be approved subject to the following <br />conditions: <br />1. That the permit is granted for the property <br />as described in the application and any attach- <br />ments thereto, and as shown on the attached <br />plan, labeled Exhibit A. <br />- 5 - <br />
