TEST RESULTS/REPORTS <br /> <br /> A. All test results, evaluations and interpretations will be rendered to City <br /> in writing within three weeks after all tests are completed (composite <br /> group results). Confidentiality of program participants' individual results <br /> will be strictly adhered to (See Paragraph 7). <br /> <br /> B. Contractor agrees to notify City at least 90 days prior to any destruction <br /> of any records which may contain City results (not individual records). <br /> Upon such notification, City may request and take possession of such records <br /> from Contractor. <br /> <br /> C. All group results, evaluations and interpretations will be the exclusive <br /> property of City, to the extent permitted by state, local and federal <br /> regulations. <br /> <br />5. INDEMNIFICATION <br /> <br /> A. Contractor agrees to defend, indemnify and hold harmless the City of Pleasanton, <br /> its officers, employees and agents, from any and all claims, omissions, <br /> liabilities and losses by whomever asserted arising out of acts or omissions of <br /> Contractor in the performance of the scope of work except those arising by <br /> reason of the sole negligence of the city of Pleasanton, its officers, <br /> employees, or agents. <br /> <br /> B. City agrees to defend, indemnify and hold harmless Contractor, its officers, <br /> employees and agents, from any and all claims, liabilities and losses by <br /> whomever asserted arising out of acts or omissions of City in performance o~ <br /> the scope of work except those arising by reason of the sole negligence of <br /> Contractor, its officers, employees and agents. <br /> <br />6. INSURANCE <br /> <br /> Contractor has procured and agrees to maintain throughout the duration of this <br /> contract a policy or policies of insurance including the following: <br /> <br /> A. Worker's Compensation insurance for contractot's employees. Such insurance <br /> shall meet statutory requirements. <br /> <br /> B. General liability insurance in an amount of not less than $1,000,000, <br /> <br /> C. Property damage insurance in an amount of not less than $500,000. <br /> <br /> D. Professional liability converage in an amount of not less than $1,000,000. <br /> <br /> <br />
