CONTRACT FOR CONSULTANT SERVICES <br /> <br /> Amendment No. 1 <br /> George E. Homolka, Inc. <br /> <br /> THIS AMENDMENT NO. 1 TO CONTRACT FOR CONSULTANT SERVICES, <br />executed on October 4, 1988, is made and entered into this 12th <br />day of December, 1989, by and between the CITY OF PLEASANTON, a <br />municipal corporation (hereinafter referred to as "City") and <br />GEORGE E. HOMOLKA, INC., a California Corporation (hereinafter <br />referred to as "Consultant"). <br /> <br /> W I T N E S S E T H: <br /> <br /> A. Consultant and City entered into an Agreement entitled <br />"Contract for Consultant Services" on October 4, 1988. <br /> <br /> B. Both parties desire to amend the above-stated Agreement <br />in order to provide Consultant a seven percent (7%) increase in <br />compensation. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants and <br />agreements contained herein, City and Consultant agree upon the <br />modifications to the original Agreement and Amendment No. 1 as <br />follows: <br /> <br /> 1. Paragraph 6 of the Agreement is hereby amended as <br /> follows: <br /> <br /> Compensation. For the services to be rendered <br /> hereunder, City shall pay Consultant on a fixed-fee <br /> basis in the amount of $125,000.00 per year, beginning <br /> on the date of the execution of this contract and shall <br /> be paid in equal monthly installments. The fixed fee <br /> will be renegotiated for subsequent years no less than <br /> one month prior to the beginning of a new yearly period <br /> to consider the effects of inflation and other expenses, <br /> but in no case shall be less than $125,000.00 without a <br /> change in the Scope of Work. <br /> <br /> City shall pay Consultant an additional amount of Eight <br /> Thousand Seven Hundred Fifty Dollars and no cents <br /> ($8,750.00) on or about January 2, 1990, but no later <br /> than January 15, 1990. This increase in compensation <br /> shall be considered a seven percent (7%) increase <br /> beginning on October 4, 1989 for the remainder of the <br /> initial contract period (until October 4, 1990). <br /> <br /> <br />
