1. A clinic licensed pursuant to Chapter 1 of Division 2 of the California Health & Safety Code, as amended. 2. A health care facility licensed pursuant to Chapter 2 of Division 2 of the California Health & Safety Code, as amended. 3. A residential care facility for persons with chronic life-threatening illness licensed pursuant to Chapter 3.01 of Division 2 of the California Health & Safety Code, as amended. 4. A residential care facility for the elderly licensed pursuant to Chapter 3.2 of Division 2 of the California Health & Safety Code, as amended. 5. A hospice or a home health agency, licensed pursuant to Chapter 8 of Division 2 of the California Health & Safety Code, as amended. C. "Person with an Identification Card" shall have the meaning given that term by California Health & Safety Code §11362.7, as amended. D. "Primary Caregiver" shall have the meaning given that term by California Health & Safety Code §11362.7, as amended. E. "Qualified Patient" shall have the meaning given that term by California Health & Safety Code § 11362.7, as amended. 6.18.020 Operation of Medical Marijuana Dispensaries Prohibited. No person shall operate or permit to be operated a Medical Marijuana Dispensary in or upon any premises in the city. 6.18.030 Penalty. Any person violating any of the provisions of this Chapter shall be guilty of a misdemeanor. Any person convicted of a misdemeanor under the provisions of this Chapter shall be punished by a fine of not more than one thousand dollars ($1,000.00) or by imprisonment for a period not exceeding six (6) months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this Chapter is committed, continued or permitted by such person and shall be punished accordingly.
