(3) Pay Agent's fee under Section 6 of this Agreement; <br /> <br /> {4) Pay reasonable attorney's fees and other necessary costs <br />incurred in connection with actions to terminate tenancies when such actions <br />have been authorized in writing by Owner in accordance with Section 14 of this <br />Agreement. If any attorney fees are collected from a party to the action, the <br />Agent will deposit the fees to the "Legal" line item of the Development <br />Operating Budget; <br /> <br /> (5) Pay for expenditures authorized for maintenance and repair <br />in Subsection 15{d) of this Agreement; <br /> <br /> (6) Pay for the costs of utilities and services as authorized <br />in Section 16 of this Agreement; <br /> <br /> (7} Pay salaries and benefits of "on-site" personnel hired <br />pursuant to Section 17 of this Agreement and the payroll taxes and other <br />payments required by law to be paid to local, State and Federal governments in <br />connection with the employment of such personnel; <br /> <br /> {8} Pay for the expenses necessary to operate the Development, <br />which expenses and amounts are included in the Annual Operating Budget, <br />prepared and approved pursuant to Section 19 of this Agreement; <br /> <br /> {9) Pay for the independent audit as required by Subsection <br />20{d), respectively, of this Agreement; <br /> <br /> (10) Pay for insurance as required by Section 23 of this <br />Agreement; <br /> <br /> {11) Pay to Owner, Owner's distribution, in accordance with the <br />Annual Operating Budget and Regulatory Agreement; and <br /> <br /> (12) Pay other items of expense approved in writing by Owner and <br />the City. <br /> <br /> {c} Reserve Fund for Replacement Account: Disbursement may be made <br />from this account only pursuant to those conditions and for those purposes <br />described in the Management Plan, the Regulatory Agreement and approved by the <br />City and CHFA. <br /> <br /> {d) The Agent shall draw no checks nor incur any obligation in an <br />amount exceeding that shown in the attached Exhibit "B" incorporated herein, <br />without the express written permission of the Owner, except as necessary for <br />emergency repairs required to avoid injury to persons or property. <br /> <br /> 14. Enforcem~nt of Leases. Agent will secure full compliance by each <br />tenant with the terms of the tenant's lease. Voluntary compliance will be <br />emphasized and Agent will counsel tenants and make referrals to community <br />agencies in cases of financial hardship or under other circumstances deemed <br />appropriate by Agent, so that involuntary termination of tenancies may be <br />avoided to the maximum extent consistent with sound management of the <br />Development. Nevertheless, and subject to the procedures prescribed in the <br />Management Plan, Agent may lawfully terminate any tenancy when, in Agent's <br />judgment sufficient cause {including but not limited to non-payment of rent} <br /> <br />19:MGMTAGR.EHI {10/27/89) 7 <br /> <br /> <br />
