(f) Develop and maintain a policy and procedure for the <br /> selection and rejection of applicants which shall be approved by the City ~nd <br /> CHFA; <br /> <br /> {g} Assure that tenant selection is carried out without <br />favoritism or partiality and that no preference is given to any applicant other <br />than as provided in this Agreement, the Management Plan, Ground Lease, <br />Owner/Grantee Agreement, City Resolutions or required by Law; <br /> <br /> (h) Give each tenant selected, at the time of acceptance, a <br />written copy of the approved tenant eviction procedures for the Development and <br />all amendments thereto; and <br /> {i) Where necessary, conduct such additional marketing as <br />reasonably required to fulfill affirmative marketing goals and meet other goals <br />of the Management Plan. <br /> <br /> 10. Rentals. Agent will offer for rent and will rent the dwelling units <br /> in the Development. With respect thereto, the following will apply: <br /> <br /> (a) Agent will follow the tenant selection policy described in the <br />Management Plan; <br /> <br /> {b) Agent will show the premises to prospective tenants; <br /> <br /> (c) Agent will take and process applications for rentals. If an <br />application is rejected, the applicant will be told the reason for the <br />rejection. The rejected application and the reason for rejection shall be kept <br />on file for three {3) years. A current list of prospective tenants will be <br />maintained; <br /> <br /> (d) Agent will prepare all tenant leases and will execute the same <br />in its name, identified thereon as Agent for the Owner. The terms of the <br />leases will comply with the pertinent provisions of the Regulatory Agreement, <br />the HDG Covenants, the HDG Owner/Grantee Agreement and the deeds of trust, and <br />shall be approved by the City and CHFA; <br /> <br /> (el .Owner will furnish Agent with rent and income schedules. In no <br />event shall such rents or other charges specified in Owner's schedules be <br />exceeded. The Owner shall be responsible for obtaining the City's and CHFA's <br />approval prior to establishing any rent schedules in accordance with the Ground <br />Lease, the HDG Owner/Grantee Agreement and Regulatory Agreement; <br /> <br /> {f) Agent will counsel all prospective tenants regarding eligibility <br />and will prepare and verify eligibility certifications and recertifications in <br />accordance with the Management Plan, the Regulatory Agreement, HDG Covenants <br />and HDG Owner/Grantee Agreement; and <br /> <br /> (g) Agent will collect, deposit and disburse security deposits in <br />accordance with the tenant's lease and State law. <br /> <br /> 11. Collection of Rents and Other Receipts. Agent shall collect when due <br />all rents, charges and other amounts receivable in connection with the <br />management and operation of the Development.
