rescinded by Property Owner if, after the filing of the <br />notice of default and before the sale, Property Owner <br />performs the obligations described herein as well as <br />reimburses City for all costs, fees, and expenses of bringing <br />this action. <br /> <br />VI. ATTORNEY'S FEES <br /> <br /> If City commences an action against Property Owner <br />arising out of or in connection with this agreement, City <br />shall be entitled to have and recover reasonable attorney's <br />fees and costs of suit. <br /> <br />VII. Any <br />party or successor in interest may change the foregoing <br />address by giving notice of a new address to each other party <br />in the manner herein provided. Notice shall be considered <br />received two days after the time of mailing. <br /> <br />VIII. SUCCESSORS IN INTEREST <br /> <br /> This agreement shall run with the land and be binding <br />upon any and all heirs, assigns, and successors in interest <br />of Property Owner having an interest in the property <br />described in Exhibit "A". <br /> <br />IX. RECORDATION <br /> <br /> This agreement shall be recorded in the Office of the <br />County Recorder of Alameda County. Any expense of recording <br />this agreement shall be paid by Property Owner. <br /> <br />X.
