CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-462 <br /> <br /> RESOLUTION ADDING AGENDA ITEM REGARDING A <br /> RESPONSE TO THE ENVIRONMENTAL PROTECTION <br /> AGENCY WITH REGARD TO THE EXISTING <br /> INCINERATOR AT LAWRENCE LIVERMORE LAB <br /> <br />WHEREAS, at its meeting of November 7, 1989, Council <br /> received testimony regarding public concern about <br /> the hazardous condition of the existing incinerator <br /> at the Lawrence Livermore Laboratory and the <br /> proposed actions of the Environmental Protection <br /> Agency; and <br /> <br />WHEREAS, the period in which the EPA will receive testimony <br /> regarding the incinerator closes November 17, 1989, <br /> which is before the next scheduled Council <br /> meeting; and <br /> <br />WHEREAS, consideration of this subject matter was not set <br /> forth on the City Council agenda for November 7, <br /> 1989, because information on the closing date for <br /> testimony to the EPA was not available until after <br /> the November 7, 1989 agenda was posted; and <br /> <br />WHEREAS, the Brown Act permits the Council to add an item to <br /> the agenda upon a two-thirds vote of the Council <br /> that the item arose after the time the agenda was <br /> posted; and <br /> <br />WHEREAS, whether to adopt a resolution to support the <br /> procedures of the Environmental Protection Agency <br /> is a critical decision because the period to <br /> receive testimony closes November 17, 1989, before <br /> the City Council meets again. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Based on the findings set forth above, a <br /> resolution in support of the Environmental <br /> Protection Agency Administrative Procedures is <br /> hereby added to the November 7, 1989 agenda for <br /> Council consideration and action, if necessary. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
