RESOLUTION NO. 07-133 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING A NEGATIVE DECLARATION FOR THE APPLICATION OF <br />BARNABAS NAGY, AS FILED UNDER CASE PUD-93-02-09M/PCUP-182 <br />WHEREAS, at its meeting of June 19, 2007, the City Council received a proposed <br />Negative Declaration for the application of Bamabas Nagy for a major modification to the <br />Ruby Hill PUD Development Plan to relocate the existing sales office building on Ruby Hill <br />Boulevard northwesterly along Vineyard Avenue, change the existing office use to <br />restaurant use, and establish a pad location and design guidelines for a future <br />single-family residence; and for a conditional use permit to allow alcoholic beverage <br />service at the restaurant after 10:00 p.m., at the property located at 2001 Ruby Hill <br />Boulevard; and <br />WHEREAS, the City Council received and reviewed the Initial Study, dated <br />May 9, 2007, and received the recommendations of the staff and Planning Commission; <br />and <br />WHEREAS, a duly noticed public hearing was held on June 19, 2007, at which <br />time the public was given the opportunity to comment on the environmental impacts of <br />the proposed project; and <br />WHEREAS, the City Council has reviewed the potential impacts in accordance <br />with the applicable state and local guidelines governing the preparation of Negative <br />Declarations and Environmental Impact Reports; and <br />WHEREAS, the City Council finds that the proposed project would not have any <br />significant adverse effects on the environment; and <br />WHEREAS, the City Council further finds that the proposed project will have no <br />potential for adverse impacts on the site's wildlife. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br />THE FOLLOWING: <br />SECTION 1. Approves the Negative Declaration for the application of Barnabas <br />Nagy for a major modification to the Ruby Hill PUD Development Plan to relocate the <br />existing sales office building on Ruby Hill Boulevard northwesterly along Vineyard <br />Avenue, change the existing office use to restaurant use, and establish a pad location <br />and design guidelines for a future single-family residence; and for a conditional use <br />permit to allow alcoholic beverage service at the restaurant after 10:00 p.m., at the <br />property located at 2001 Ruby Hitl Boulevard. <br />
