RESOLUTION NO. 07-132 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING A CONDITIONAL USE PERMIT FOR BARNABAS NAGY, AS FILED <br />UNDER CASE PCUP-182 <br />WHEREAS, Bamabas Nagy has applied for a PUD major modification to the Ruby <br />Hill PUD Development Plan to relocate the existing sales office building on Ruby Hill <br />Boulevard northwesterly along Vineyard Avenue, change the existing office use to <br />restaurant use, and establish a pad location and design guidelines for a future <br />single-family residence; and for a conditional use permit to allow alcoholic beverage <br />service at the restaurant after 10:00 p.m., at the property located at 2001 Ruby Hill <br />Boulevard; and <br />WHEREAS, zoning for the property is PUD-OS/A/LDR (Planned Unit Development <br />-Open Space/Agriculture/Low Density Residential) District; and <br />WHEREAS, a duly noticed public hearing was held before the City Council on <br />June 19, 2007, at which time all pertinent testimony and documents were received; and <br />WHEREAS, the City Council determined that the proposed conditional use <br />permit is consistent with the approval of similar use permits for other similar projects. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br />THE FOLLOWING: <br />SECTION 1. Approves Case PCUP-182, the application of Bamabas Nagy for a <br />conditional use perrnit to allow alcoholic beverage service after 10:00 p.m., at the <br />restaurant to be located at 2001 Ruby Hill Boulevard, subject to the conditions of approval <br />shown on Exhibit B, attached hereto and incorporated herein by this reference. <br />SECTION 2. This resolution shall become effective upon the effective date of <br />Ordinance No. 1956. <br />PASSED, APPROVED, AND ADOPTED by the City Council of the City of <br />Pleasanton at a regular meeting held on June 19, 2007. <br />I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the <br />foregoing resolution was adopted by the City Council at a regular meeting held on the <br />19~h day of June 2007, by the following vote: <br />Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor <br />Hosterman <br />Noes: None <br />Absent: None <br />
