BAS~N RIDOB/AUGU~IN BEENAL PARK <br /> OPERATING AGREEMENT <br /> <br /> THIS AG~ is made th{,, d~ of , <br />ber, veen the CiW of Pleasant~n, a mruntcip~ation (hetejafter "(jtt~') and the <br /> Bast ay <br />Regional Park District, a body corporate and politic (h~ "District"). <br /> <br /> V,'rtBi~.AS, CrTY and DISTRICT own and hold contiguous parldands of a similar <br />nature on Pleasanton Ridlie ('~Ridge") for the purpose of operalin~ and rn~i~._~{nqng park <br />and open space lands for public use; and <br /> <br /> ~, CITY and DISTRICT and the public wxll realize benefit from the CITY <br />and DISTRICT cooperatinS in ~e operation and the sharinS c/ce~si,~ services that are <br />necessary for safe park operation. <br /> <br /> NOW, THEREFORE, in consideration of the mutual promises expressed herein, the <br />parties agree as folIows: <br /> <br /> 1. PUBLIC <br /> <br /> A. Members of Re public may access the Pd~e' at ~pe~fied locations on <br /> the contiguous boundaries of C1TY and DISFRICr parkIands and may <br /> l~avel on deggnated u-a{1, on lauds beIongin~ to each agent. The <br /> d <br /> locatons for esignated trafi access are set forth on Exhibit "A' <br /> attache~i to this A~reemen?. TRi section is not intended to affect any <br /> !imamlions that either agency has with respect to i~s separate public <br /> ennnces to the Ridge. <br /> <br /> B. Nott~ng in ~_h~a section or ~ement is intended w permit vehicular <br /> access by the public w the upper arm of the Rid~ge. Because <br /> siguiicam restrictions concerninS velicular acc~ apply to aTY- <br /> owned proper~ along the Ridge, DISTRICt shall discuss with ClTY <br /> any o~ the DISTRICTs pins w permit pubic vehicul~ acce~ to its <br /> ridgerap property prior to permitt~ same, <br /> <br /> C. The public wfil be subject to ~e rules and re~n!!~tions which each <br /> a~ency enforces on its own prope. rt~.
