B. Developer plans to develop the Property as a <br />commercial and office park ("Project"). <br />C. City wishes to (i) eliminate uncertainty in the <br />comprehensive development planning of large-scale industrial <br />and commercial projects, (ii) secure orderly development and <br />progressive fiscal benefits for public services planning, and <br />(iii) ensure attainment of the goal of maximum effective <br />utilization of resources at the least economic cost to the <br />public. <br />D. Developer submitted to City a request for major <br />modification to PUD-80-2 (Ordinance No. 975) for approval of <br />(i) the design guidelines, (ii) the master plan and (iii) <br />roadway and perimeter improvements (PUD-80-2-2M). As a <br />condition to the major modification seventeen (17) conditions <br />were attached including floor area ratio limitation for the <br />project (Condition #10); a traffic level of service condition <br />requiring the implementation of additional mitigation measures <br />(Condition #14), a requirement to participate in park and <br />recreation improvements (Condition #15) and a requirement for <br />school mitigation impact fee (Condition #16). <br />E. By letter of June 3, 1986, Developer agreed to <br />accept the additional limitations on the PUD-80-2 as <br />consideration for this Development Agreement. <br />F. On June 3, 1986, the City Council introduced <br />Ordinance No. 1257 approving the proposed major modification <br />(PUD-80-2-2M) with conditions attached as Exhibit A. <br />-2- <br />
