PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 2841 <br />RESOLUTION RECOMMENDING APPROVAL OF A DRAFT DEVELOPMENT <br />AGREEMENT FOR BERNAL AVENUE ASSOCIATES <br />WHEREAS, on June 3, 1986, the City Council approved a major <br />modification to the Koll Center Business Park Planned <br />Unit Development. As part of their review of the major <br />modification, the City attached several new conditions <br />of approval to the original Planned Unit Development <br />(Fromm Business Park). The City Council at that time <br />indicated it would be amenable to reviewing a <br />development agreement to govern the future development <br />of the Koll Center project; and <br />WHEREAS, at their duly noticed public hearing of September 24, <br />1986, the Planning Commission reviewed a draft <br />development agreement proposed by City staff after <br />considering all public testimony, relevant exhibits and <br />recommendations of the City staff; and <br />WHEREAS, a Negative Declaration was prepared for the major <br />modification approved for the subject property. <br />Development agreement for the subject property was <br />included within the scope of that Negative Declaration <br />and, therefore, this application is not considered to be <br />a new project under the California Environmental Quality <br />Act (CEQA). <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Recommends approval of the draft Development <br />Agreement for Bernal Avenue Associates attached hereto <br />and made part of this case by reference, but adding <br />language to Section 6 which would <br />to revegetate the graded portions <br />landscaping to be approved by the <br />types of species and size no less <br />the letter dated 9/23/86 attached <br />of this case by reference. <br />require the developer <br />of arroyo with <br />Planning Director with <br />than those included in <br />hereto and made part <br />Section 2.
