PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 2841 RESOLUTION RECOMMENDING APPROVAL OF A DRAFT DEVELOPMENT AGREEMENT FOR BERNAL AVENUE ASSOCIATES WHEREAS, on June 3, 1986, the City Council approved a major modification to the Koll Center Business Park Planned Unit Development. As part of their review of the major modification, the City attached several new conditions of approval to the original Planned Unit Development (Fromm Business Park). The City Council at that time indicated it would be amenable to reviewing a development agreement to govern the future development of the Koll Center project; and WHEREAS, at their duly noticed public hearing of September 24, 1986, the Planning Commission reviewed a draft development agreement proposed by City staff after considering all public testimony, relevant exhibits and recommendations of the City staff; and WHEREAS, a Negative Declaration was prepared for the major modification approved for the subject property. Development agreement for the subject property was included within the scope of that Negative Declaration and, therefore, this application is not considered to be a new project under the California Environmental Quality Act (CEQA). NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Recommends approval of the draft Development Agreement for Bernal Avenue Associates attached hereto and made part of this case by reference, but adding language to Section 6 which would to revegetate the graded portions landscaping to be approved by the types of species and size no less the letter dated 9/23/86 attached of this case by reference. require the developer of arroyo with Planning Director with than those included in hereto and made part Section 2.
