~\ ~ \ <br />~~_ <br />ALAMEDA COUNTY, <br />CALIFORNIA <br />ORDINANCE N0. 1270 <br />APPROVING THE APPLICATION <br />OF PROMETHEUS DEVELOP- <br />MENT COMPANY FOR A MAJOR <br />MODIFICATION TO PUD-85-17 <br />(PUD-85-17M) <br />WHEREAS, a[ its meeting of <br />August 5, 1986, Ciry Council. <br />adopted Resolution Na. 86373 <br />of Prometheus Development <br />Company fora 456 Unit Mul[i- <br />Family Residential Complex and <br />request far Lower-Income Exemp- <br />tion MGrowth Management Pro- <br />gram; and <br />WHEREAS, based on the Initial <br />Environmental Study, a negative <br />declaration was adapted by Coun- <br />cil on August 5, 1986; <br />WHEREAS, Council received <br />the Planning Commission's rec- <br />ommendation for approval of the <br />development plan; and <br />WHEREAS, a duly noticed pub- <br />lic hearing was held on August 5. <br />1986: and <br />WHEREAS, the Ciry Council '~ <br />finds that this development plan <br />is consistent with the General <br />Plan policies of the City of <br />Pleasanton; <br />THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />Settian 1: That the motor motl- <br />ifiwtion he adopted subject [o the <br />following conditions: <br />A. That the development fR <br />suDStantially as shown on the re- <br />vised plans. dated June 25, <br />1986, Exhibit A, on file with the <br />Planning Department, except: <br />B. That the applicant DQ re- <br />quired to assign and clearly label <br />all on-site parking spaces. <br />C. That red Curbs and "No <br />Parking" signs as required by <br />state law to enable enforcement, <br />I be installed along all curbs along <br />i interior access mods in order to <br />maintain clear fire lanes a[ all <br />times. <br />D. That the buildings be con- <br />structed to attain the Ciry's interi- <br />or noise level of 45 dba. <br />E. That the final design of the <br />"Tomax" type soundwall pro- <br />posed along the northern property <br />line be submitted for review to the <br />Planning Director prior to the is- <br />suance of buiding permits. <br />F. That additional parking <br />ofhets, as determined by the <br />Planning Director, De located <br />along [he rear driveway to main- <br />tain safe vehicle speeds. <br />G. That any changes to the <br />design of patio walls or other <br />building features be reviewed by <br />the Planning Director prior to the <br />issuance of building permits. <br />H. That the walkway which <br />transverses the entire project be <br />given a special paving design <br />treatment through the parking ar- <br />eas inorder to be better discerned <br />by motorists and pedestrians. <br />I. That [he final design, col- <br />ors, and landscape Dlan for the <br />project sign be submitted and ap- <br />proved to the Planning Depart- <br />ment prior [o the issuance of <br />building permits. <br />J. That [he developer shall <br />install a separated eight foot (89 <br />wide P.C.C. sidewalk along the <br />Owens Drive frontage and a five <br />foot (5') wide P.C.C. sidewalk <br />along the Andrews Drive frontage <br />of [he development. All of the <br />sidewalks shall be installed to <br />Ciry standards. <br />K. The developer shall design <br />the Andrews Drive entrance drive- <br />way to function under the pro- <br />posed loading to the satisfaction <br />of [he Ciry Engineer. <br />L. The tleveloper shall design <br />the proposed drweway at Old <br />Santa Rita Road and the pro- <br />posed driveway at Owens Drive [o <br />be 30 tt. wide, street type open- <br />ing. These tlriveways shall Oe Or <br />signetl antl installed to the satis- <br />faction of [he Ciry Engineer. <br />M. The developer shall rede- <br />sign and reconstruct, as required, <br />the north terminus of the existing <br />median island and [he existing <br />tlouble left turn lane striping in <br />Old Santa Rita Road in order to <br />provide for left turn stacking. This <br />work shall be done at the devel- <br />oper's expense [o the satisfaction <br />of [he City Engineer. <br />N. That [he approval of this <br />motor modification Shall he sub- <br />ject to the above listed conditions <br />which supersede all precious con- <br />ditions of approval for case PUD- <br />85-17. <br />0. That the play equipment <br />installed within the tot IOC area <br />shall be designed for use by chil- <br />dren 2 to 10 years of age. The <br />design of such equipment shall be <br />submitted for review and approval <br />by the Planning Director prior to <br />issuance of any building permits. <br />P. That this development <br />shall be sublet! to all Standartl <br />Conditions of Development, at- <br />tached hereto and made part of <br />[his case by reference, except <br />i conditions 12, 13, 23, 25, 29, <br />ii 31, 33, 46, and 49. <br />CITY COUNCIL OF THE <br />CITY OF PLEASANTON <br />Section 2: Approves the devel- <br />opment plan for Prometheus De- <br />velopment Company, sublet! to <br />the proposed conditions of <br />approval. <br />Section 3: The Ciry stag is di- <br />rected to draft a Lang Term <br />Agreement eflectua[ing the lower- <br />income exemption under the ex- <br />isting Guidelines, which includes <br />the following elements: <br />A. Tnat the 114 deisgnated <br />IoweFincome units shall DQ Sub- <br />ject to rent limitations for at least <br />fifteen (15) years; <br />8. Rent adlustments may be <br />allowed annually based upon <br />HUD income guidelines; <br />C. The developer and subse- <br />quentsuccessors shall be respon- <br />sible for yearly status reports on <br />the administration of the lower- <br />income information on occupancy <br />and income of tenants. <br />D. That the exemption shall <br />lapse eighteen UB) months from <br />the date of approval unless con- <br />struction has commented on any <br />building in the project; and <br />E. That the agreement shall <br />run with the land. <br />Sedlor 4: This ordinance shall <br />be publishetl once within fifteen <br />(151 days after its adoption in <br />"the Valley Times" a newspaper <br />of general circulation published in <br />the Ciry of Pleasanton. <br />Section 5: This ordinance shall <br />be ereective thirty (30) days after <br />the date of its final passage and <br />adoption. <br />INTRODUCED at a regular <br />meeting of the Ciry Council of the <br />Ciry of Pleasanton on August 5, <br />1986. <br />ADOPTED at a regular meeting <br />of the Cily Counctl of the Ciry of <br />Pleasanton on August 19, 1986 <br />by the following vote: <br />AYES: Councilmembers - Mer- <br />cer, Butler and Woo0 <br />NOES: Councilmember Mohr <br />ABSENT: Major Brander <br />ABSTAIN: None <br />FRANK C.
