CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 89-450 RESOLUTION UPHOLDING THE APPEAL OF THE CITY COUNCIL (AP-89-15) AND DENYING THE APPLICATION OF WAYNE JOHNSON (CASE V-89-25) FOR A VARIANCE FROM THE MUNICIPAL CODE TO RETAIN A SATELLITE DISH LOCATED AT 6289 GARNER COURT WHEREAS, at its meeting of September 27, 1989, the Board of Adjustment approved the application of Wayne Johnson for a variance from the Municipal Code to locate a 14'10" tall satellite dish in a backyard, eight feet from the rear property line, at 6289 Garner Court (Case V-89-25); and WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council submitted an appeal to the City Clerk of the City of Pleasanton; and WHEREAS, the matter on appeal came before the City Council for public hearing on October 31, 1989; and WHEREAS, after hearing all interested persons and receiving and considering all relevant evidence presented at the hearing, the City Council does now find as follows: 1. The appeal was timely filed with the City Clerk. 2. The appeal is from the decision of the City of Pleasanton Board of Adjustment to approve, with conditions, a variance from the Municipal Code, which variance would permit the continued location of a 14'10" tall satellite dish in a backyard, eight feet from the rear property line, at 6289 Garner Court. 3. Notice of the hearing on appeal was given as required by law. 4. All persons interested in the matter were allowed to speak. 5. The preponderance of evidence is that this application for a variance (Case No. V-89-25) should not be approved based on the following findings:
