CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-450 <br /> <br /> RESOLUTION UPHOLDING THE APPEAL OF THE <br /> CITY COUNCIL (AP-89-15) AND DENYING THE <br /> APPLICATION OF WAYNE JOHNSON (CASE <br /> V-89-25) FOR A VARIANCE FROM THE <br /> MUNICIPAL CODE TO RETAIN A SATELLITE DISH <br /> LOCATED AT 6289 GARNER COURT <br /> <br />WHEREAS, at its meeting of September 27, 1989, the Board of <br /> Adjustment approved the application of Wayne <br /> Johnson for a variance from the Municipal Code to <br /> locate a 14'10" tall satellite dish in a backyard, <br /> eight feet from the rear property line, at 6289 <br /> Garner Court (Case V-89-25); and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the City Council submitted an <br /> appeal to the City Clerk of the City of Pleasanton; <br /> and <br /> <br />WHEREAS, the matter on appeal came before the City Council <br /> for public hearing on October 31, 1989; and <br /> <br />WHEREAS, after hearing all interested persons and receiving <br /> and considering all relevant evidence presented at <br /> the hearing, the City Council does now find as <br /> follows: <br /> <br /> 1. The appeal was timely filed with the City <br /> Clerk. <br /> <br /> 2. The appeal is from the decision of the City of <br /> Pleasanton Board of Adjustment to approve, <br /> with conditions, a variance from the <br /> Municipal Code, which variance would permit <br /> the continued location of a 14'10" tall <br /> satellite dish in a backyard, eight feet from <br /> the rear property line, at 6289 Garner Court. <br /> <br /> 3. Notice of the hearing on appeal was given as <br /> required by law. <br /> <br /> 4. All persons interested in the matter were <br /> allowed to speak. <br /> <br /> 5. The preponderance of evidence is that this <br /> application for a variance (Case No. V-89-25) <br /> should not be approved based on the following <br /> findings: <br /> <br /> <br />
