_ AGREEMENT FOR ENGINEERING SERVICES <br /> BETWEEN <br /> BROWN ~AND CALDWELL AND THE CITY OF PLEASANTON <br /> FOR <br /> EAST AHADOR TRUNK SEWER REHABILITATION DESIGN <br /> <br /> THIS AGREEMENT is made and entered into this day <br /> <br />of , 1989, by and between the CITY OF PLEASANTON, <br /> <br />a municipal corporation (hereinafter referred to as "City"), and <br />Brown and Caldwell, a California Corporation (hereinafter <br />referred to as "Consultant"). <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, Consultant is qualified to provide, and is <br />experienced in providing, engineering services and has offered <br />its services for the purposes specified in this Agreement; and <br /> <br /> WHEREAS, In the judgment of the City, it is necessary and <br />advisable to employ the services of Consultant for the purpose of <br />undertaking their engineering services. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenants, <br />agreements, and conditions contained herein, City and Consultant <br />agree as follows: <br /> <br /> 1. Consultant's Services. Consultant shall diligently <br />perform the services and furnish the materials, reports, maps, <br />etc., as hereinafter set forth in Exhibit "A", Scope of Work, <br />attached hereto and incorporated herein by reference. <br /> <br /> 2. City Services. To assist Consultant in this project, <br />City shall provide negatives of aerial photographs, any existing <br />plans of the area on file, necessary direction, and plan checking <br />within a reasonable time. <br /> <br /> 3. Staff. Project Manager for Consultant shall be <br />Grace Chow Consultant shall not change the project manager <br />without prior approval of the City. <br /> <br /> 4. Sufficiency of Consultant's Work. Consultant agrees <br />that all maps, plans, and specifications prepared for City shall <br />be adequate and sufficient to meet the purpose for which they are <br />prepared. <br /> <br /> <br />
