4. Subcontracted services directly applicable to Project. <br /> <br /> 5. Living and traveling expenses of employees when away <br /> from home office on business directly applicable to <br /> Project. <br /> <br /> 6. Automobile mileage directly applicable to Project at 25 <br /> cents per mile. <br /> <br />III. LIMITATION OF COST AND TIME <br /> <br />Consultant estimates that the cost for services described in <br />Exhibit A shall not exceed $97,400, and that the time for <br />completion of Project shall be as stated in the Agreement. <br />Consultant shall use its best efforts to perform the work <br />specified in Exhibit A within the estimated cost and time. <br /> <br />If at any time Consultant believes that cost shall be greater <br />than estimated, Consultant shall notify City in writing. The <br />notification shall state the revised cost estimate and, if <br />applicable, the revised time for completion. Consultant shall <br />submit such notification as early as possible, but no later than <br />10 days prior to scheduled completion of the work. <br /> <br />City shall not be obligated to reimburse Consultant for costs <br />incurred in excess of the estimated cost unless City agrees in <br />writing to do so. Consultant shall not be obligated to continue <br />performance under this Agreement or otherwise incur costs in <br />excess of the original estimate unless and until City notifies <br />Consultant in writing that the estimated cost has been increased. <br /> <br />If additional funds and time adjustments are not allotted by the <br />scheduled completion date, City shall, on written request by <br />Consultant, terminate this Agreement.
