Box 580 Pleasanton CA 94566 WAIVER OF REIMBURSEMENT THIS AGREEMENT, made and entered into this day of September, 1989, by and between the CITY OF PT~ASANTON, a California municipal corporation, hereinafter referred to as "City", and KAISER SAND AND GRAVEL, a Delaware corporation, hereinafter referred to as "Kaiser". WITNESSETH: WHEREAS, the City of Pleasanton has constructed a sanitary sewer line to a point approximately 500 feet north of the intersection of Busch Road and Kamp Drive; WHEREAS, the City of Pleasanton has constructed a water line to a point within 400 feet of Kaiser's western property line along Busch Road; WHEREAS, the City understands Kaiser has received approval from Alameda County to develop a twenty acre site for use as a recreational vehicle storage area on the north side of Busch Road; WHEREAS, the City desires to direct storm drainage runoff into a pit which is already accepting storm water runoff from properties along the south side of Busch Road owned by Pleasanton Garbage and Kiewit. NOW, THEREFORE, in consideration of the mutual covenant, agreements and conditions contained herein, City and Kaiser agree as follows: 1. City agrees to pay a license fee of $5,000.00 per year for use of Kaiser's pit for storm water storage. A copy of the license agreement is attached hereto as Exhibit "A" and incorporated herein by this reference. 2. In exchange for the City's right to drain its excess sto~rm water runoff from a seventeen (17) acre site into Kaiser's pit for one year, with annual options to renew, the City will waive its right to reimbursement costs for the extension of the sanitary sewer near the proposed Kamp Drive/Busch Road intersection. It will also waive its right to reimbursement costs to the extension of a water line in Busch Road. The estimated value the City would be waiving under this agreement is approximately $12,000 based on the following estimate: -1-
