Box 580 <br />Pleasanton CA 94566 <br /> <br /> WAIVER OF REIMBURSEMENT <br /> <br /> THIS AGREEMENT, made and entered into this day of <br />September, 1989, by and between the CITY OF PT~ASANTON, a <br />California municipal corporation, hereinafter referred to as <br />"City", and KAISER SAND AND GRAVEL, a Delaware corporation, <br />hereinafter referred to as "Kaiser". <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, the City of Pleasanton has constructed a <br />sanitary sewer line to a point approximately 500 feet north <br />of the intersection of Busch Road and Kamp Drive; <br /> <br /> WHEREAS, the City of Pleasanton has constructed a water <br />line to a point within 400 feet of Kaiser's western property <br />line along Busch Road; <br /> <br /> WHEREAS, the City understands Kaiser has received <br />approval from Alameda County to develop a twenty acre site <br />for use as a recreational vehicle storage area on the north <br />side of Busch Road; <br /> <br /> WHEREAS, the City desires to direct storm drainage <br />runoff into a pit which is already accepting storm water <br />runoff from properties along the south side of Busch Road <br />owned by Pleasanton Garbage and Kiewit. <br /> <br /> NOW, THEREFORE, in consideration of the mutual covenant, <br />agreements and conditions contained herein, City and Kaiser <br />agree as follows: <br /> <br /> 1. City agrees to pay a license fee of $5,000.00 per <br />year for use of Kaiser's pit for storm water storage. A copy <br />of the license agreement is attached hereto as Exhibit "A" <br />and incorporated herein by this reference. <br /> <br /> 2. In exchange for the City's right to drain its <br />excess sto~rm water runoff from a seventeen (17) acre site <br />into Kaiser's pit for one year, with annual options to renew, <br />the City will waive its right to reimbursement costs for the <br />extension of the sanitary sewer near the proposed Kamp <br />Drive/Busch Road intersection. It will also waive its right <br />to reimbursement costs to the extension of a water line in <br />Busch Road. The estimated value the City would be waiving <br />under this agreement is approximately $12,000 based on the <br />following estimate: <br /> <br /> -1- <br /> <br /> <br />
