CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-365 <br /> <br /> RESOLUTION APPROVING AGREEMENT WIT~ <br /> GABLES HOMOMRS ASSOCIATION TO MAINTAIN <br /> LANDSCAPING AND SOUNDWALL AND DECLARING <br /> APPROXIMATELY 26,500 SQ. FT. OF LAND AS <br /> SURPLUS AND AUTHORIZING TRANSFER OF THE <br /> SURPLUS LAND AT NO COST TO THE ADJACENT <br /> LANDOWNER <br /> <br />WHEREAS, at its meeting of September 5, 1989, the City <br /> Council reviewed the report of the Director of <br /> Public Works and Engineering (SR 89:380) regarding <br /> the maintenance of landscaping and a soundwall <br /> adjacent to the Stoneridge Drive/I-680 interchange; <br /> and <br /> <br />WHEREAS, one of the conditions of approval of PUD-85-12, <br /> Warmington Homes, was a requirement that the <br /> homeowners association maintain the landscaping on <br /> the common area adjacent to the soundwall fronting <br /> the interchange; and <br /> <br />WHEREAS, the soundwall was built on land purchased by the <br /> North Pleasanton Improvement District and to <br /> correct the situation, it is necessary to transfer <br /> the property to the homeowners association after it <br /> has been declared as surplus; and <br /> <br />WHEREAS, after a review of the staff report, the City <br /> Council makes the following findings: <br /> <br /> 1. the value received for maintenance is greater <br /> than or equal to the monetary value of <br /> approximately 26,510 square feet transferred <br /> to the Gables Homeowners Association; and <br /> <br /> 2. Given the size and configuration, which does <br /> not permit any other land use, the adjacent <br /> owner is the only potential user of the above <br /> described property; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council approves the agreement between <br /> the City of Pleasanton and Gables Homeowners <br /> Association, regarding maintenance of landscape and <br /> soundwall, a copy of which is attached hereto and <br /> incorporated herein by this reference. <br /> <br /> <br />
