CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 89-365 RESOLUTION APPROVING AGREEMENT WIT~ GABLES HOMOMRS ASSOCIATION TO MAINTAIN LANDSCAPING AND SOUNDWALL AND DECLARING APPROXIMATELY 26,500 SQ. FT. OF LAND AS SURPLUS AND AUTHORIZING TRANSFER OF THE SURPLUS LAND AT NO COST TO THE ADJACENT LANDOWNER WHEREAS, at its meeting of September 5, 1989, the City Council reviewed the report of the Director of Public Works and Engineering (SR 89:380) regarding the maintenance of landscaping and a soundwall adjacent to the Stoneridge Drive/I-680 interchange; and WHEREAS, one of the conditions of approval of PUD-85-12, Warmington Homes, was a requirement that the homeowners association maintain the landscaping on the common area adjacent to the soundwall fronting the interchange; and WHEREAS, the soundwall was built on land purchased by the North Pleasanton Improvement District and to correct the situation, it is necessary to transfer the property to the homeowners association after it has been declared as surplus; and WHEREAS, after a review of the staff report, the City Council makes the following findings: 1. the value received for maintenance is greater than or equal to the monetary value of approximately 26,510 square feet transferred to the Gables Homeowners Association; and 2. Given the size and configuration, which does not permit any other land use, the adjacent owner is the only potential user of the above described property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council approves the agreement between the City of Pleasanton and Gables Homeowners Association, regarding maintenance of landscape and soundwall, a copy of which is attached hereto and incorporated herein by this reference.
