Alameda County Waste Management Authority <br />Resolution No. 33 - July 19, 1989 <br />Page 11. <br /> <br /> - EXHIBIT B <br /> <br />ANNUAL ADJUSTMENT INDEX FOR PAYMENTS MADE TO AUTHORITY BY 0AFtAND SCAVENCER <br />COMPANY FOR IMPORT OF MUNICIPAL SOLID WASTE FROM CONTEA C0STA COUNTY FOR <br />DISPOSAL AT ALTAMONT SANITARY IANDFILL <br /> <br />There shall be an annual adjustment of the mitigation fee commencing one (1) <br />year after the date of the start of import from Contra Costs County. The base <br />rate of the mitigation fee $3.09 per ton of waste disposed will be adjusted <br />according to the following formula: <br /> <br /> (B) + (D) <br /> P = A x (C) (E) <br /> <br /> A eq~m]s the base rate of $3100 per ton. <br /> <br /> B equals the Adjusted Hourly Earnings Index Total Private Non-Agricultural <br /> (in current dollars) published by the Department of Labor, Bureau of Labor <br /> Statistics, in effect on the day that the mitigation fee adjustment takes <br /> place. <br /> <br /> C equals the Adjusted Hourly Earnings Index Total Private Non-Agricultural <br /> (in current dollars) published by the Department of Labor, Bureau of Labor <br /> Statistics, in effect on the date of first import from Contra Costs County. <br /> <br /> D equals the Gross National Product Implicit Price Deflator for Producer's <br /> Durable Equipment (Nonresidential) published quarterly by the Department <br /> of Commerce, Bureau of Economic Analysis, in effect on the day that the <br /> mitigation fee adjustment takes place. <br /> <br /> E equals the Gross National Product Implicit Price Deflator for Producer's <br /> Durable Equipment (Nonresidential)published by the Department of Commerce, <br /> Bureau of Economic Analysis, on the date of first import from Contra Costs <br /> County. <br /> <br /> P equals the adjusted base rate per ton for the succeeding twelve (12) month <br /> period. <br /> <br /> There shall be no adjustment below the base rate in effect on date of first <br /> import from Contra Costs County. <br /> <br /> Should the formula standards or publications become unavailable in the present <br /> form and on the same basis as the last standards published immediately prior <br /> to the execution of this Agreement, the parties shall agree to a replacement <br /> standard. The purpose of such replacement shall be to produce as nearly as <br /> <br /> <br />
